Falls Creek is a ski resort in the north east of Victoria on the Bogong High Plains. Members of business's (accommodation & restaurants) formed the Falls Creek Chamber of Commerce to promote tourism 'under' the Falls Creek Tourist Area Management Committee. The Falls Creek Tourist Area Management Committee under the direction of the State Electric Commission of Victoria came into effect in 1959 and from then on building sites were leased and building and sewerage controls were applied. In 1979 the Victorian State Government had established the Ski Industry of Victoria working party with a brief report on its operation. Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. Charles Gordon Watts-Phillips was born in 1849 at Forest Hill, Surrey, England, the son of Dramatic Author, Watts Phillips, and Lily Mariner. He departed England for Australia around 1874. His sister Roland was a favourite Australian actress of the early 1900s. Gordon as he was known, whilst residing in Goolwa, South Australia and working as a clerk met and married a widow, Jane Luxon (nee Miller) on the 7th August, 1876 at the Wesleyan Church in Strathalbyn, South Australia. Jane, Gordon’s elder by some 11 years was born in Ireland in 1838, the daughter of Robert Joseph Miller, a carpenter and Jane Miller. She had previously married Captain William Luxon in 1861 at Encounter Bay, South Australia at age 22 and they had four children: William (1864), George Robert (1865), Miriam Louisa (1867) and Harriet Jane (1869), all born at Encounter Bay. Gordon and Jane had two further children together: Caroline Roland Watts-Phillips (1877 Islington S.A.) and Charles Gordon Watts-Phillips (1879 Yatala, S.A.). At some stage, Jane then deserted her husband. Gordon obtained a master's certificate and was a part owner of a small trader. He had also been captain of one of the passenger boats on the Darling River. He was reputedly a popular coastal skipper. By 1891 Gordon was the Captain of the S.S Omeo operating around Sale, Victoria. In August of that year some of the heaviest flooding of the Thomson River ever experienced in twenty years occurred over the 3rd and 4th of August. Gordon, and others, rescued the lives of many families over that period for which he was awarded a Bronze Medal by the Royal Humane Society. By 1892 the S.S. Omeo had passed to another Captain and Gordon subsequently retired from the sea and moved to Melbourne. Whilst residing in Coburg, Victoria, Gordon met Mary Hilda Harvey Huxley who was living in Brunswick. Mary was born in Horsham, the daughter of George Harry Huxley, a miner, and Emma Deane. Having not heard from Jane for some years and believing her dead, Gordon and Mary marry at Carlton on Christmas Eve, 1900. Interestingly, an announcement of the marriage was not placed in The Age newspaper until September 1903, nearly three years after the event by which time Gordon and Mary had a son, Victor Gordon Watts-Phillips, born 8 February 1903 in Carlton. Within months of the placement of this marriage announcement, his former wife, Jane, makes a reappearance but apparently does not interfere and Mary and Gordon continue to live together as husband and wife. Around the same time in late 1903, Gordon’s brother, Basil Watts Phillip wrote from London to the Victoria Police seeking assistance to locate his brother. He had last heard from him in a letter dated Cunninghame, Gippsland, 1891. He indicated that about 1893 Gordon and Jane and their two children were living at Beaconsfield Parade, Albert Park but the whereabouts of all was now unknown. He mentioned Gordon had also been awarded 21 guineas by Judge Boucaut on the 26th February 1884, also a silver medal, for arresting two ruffians who had brutally assaulted a jockey (in South Australia) and that he had been awarded the Royal Humane Society's medal, London, and in 1891, was presented with the Royal Humane Society's certificate of merit (Victoria). Basil also stated his brother had lost the sight of one eye through a stab he received in New York and had a scar on his temple, one on the wrist, two under the shoulder blade, and one on the thigh, and two bullet wounds in the leg. Basil’s quest was published in the Melbourne Herald and assistance was soon forthcoming to the Police. In June 1906 Gordon made his Will, leaving all his estate to his youngest son Victor. Mary was appointed Executrix and it was witnessed by Olive Huxley, married woman, and James Huxley, a pottery maker. James was subsequently killed in France in May 1918. Gordon and Mary have a second son, Basil Douglas born in Carlton in 1911 but he dies as toddler in 1913. At some point Gordon and Mary made their home at Eltham though official electoral roll records record them at Little Flinders Street Melbourne, employed as a caretaker and from 1906 in Brunswick as a decorator then painter. Eltham may have been a ‘holiday’ home but it seems Mary was actively engaged in the community as a newspaper report in the Advertiser in 1922 not long after Gordon’s death indicates Mary was one of the best known and best liked ladies of the Eltham district. She was actively engaged in all matters, tending towards the welfare of the district. At the time of Gordon’s death Mary was president of the Ladies' Public Hall Committee, responsible for the conduct of numerous, and successful entertainments. Gordon’s first and only legal wife, Jane Luxon Watts-Phillips nee Miller, died 6 November 1921 and was buried 8 November 1921 at Springvale Cemetery. Jane had lived 34 years in South Australia and 30 years in Victoria. With Jane now dead, Gordon was now officially a widower and just three weeks later, the retired master mariner of Eltham at age 55 remarried Mary, 42, of 174 Hickford Street, East Brunswick on the 29th November 1921 in the Parish of St Cuthbert, East Brunswick. Gordon died at their home, ‘The Rest’, at 174 Hickford Street, East Brunswick on February 9, 1922 and was buried at Eltham Cemetery on February 11. An interesting link is established with the heavy floods of August 1891 by the erection of a tombstone in the Eltham cemetery. The stone bears the inscription: - “In loving memory of (Captain) Gordon, dearly beloved husband of Mary Watts Phillips. Died 9th February 1922, aged 62 years." Beside the stone is a replica, carved in a marble scroll, of the Royal Humane Society of Australia's Certificate of merit. Part of the wording of this certificate is as follows:- “At a general court of directors holder at the offices of the society at Melbourne on the 6th day of September 1891, it was resolved that the courage and humanity displayed by Gordon Watts Phillips aged 30-years captain of S.S. Unbeknownst to Gordon, his second and subsequent legal marriage to Mary initiated a revocation of his Will of 1906, which had solely benefited his son Victor. Consequently, Mary had to apply for Letters of Administration and the only legal beneficiaries would be Mary and his two children by Jane. On June 18, 1940, at age 61, Mary married 70-year-old Arthur Ernest Fenn in Melbourne. Unfortunately for her, Arthur died a year later in July 1941 and was buried in the Cohuna Cemetery near Echuca. Mary lived a further 8 years, passing away suddenly July 4, 1948 in Carlton, and was buried July 7 with her beloved husband Gordon, at Eltham Cemetery. The suggestion of an Avenue of Honour may have been originally put forward by Lady Irvine who was a member of the Welcome Home Committee. The Avenue of Honour was established to memorialise all those from Eltham who enlisted (some of whom were still fighting overseas at the time), similarly as the Shire of Eltham (Soldiers) Memorial Park was in tribute to all from the Shire who enlisted. The twenty-seven names of those killed from Eltham were engraved on the Eltham War Memorial Obelisk unveiled in 1919 at the corner of Main Road and Bridge Street. From an article in the Heidelberg News and Greensborough, Eltham and Diamond Creek Chronicle, September 22, 1917, p. 2, it was reported: Some few weeks ago a public meeting was held in the Eltham Rechabite Hall for the purpose of forming a committee to make necessary arrangements for the return of our brave lads from the front, with the result that the following officers were elected, viz., Sir William Irvine. president; Cr. R. D. Taylor, vice-president; Rev. T. W. Sapsford, secretary; Mr R. E. Gilsenan, treasurer; with a very strong committee of local residents. Lady Irvine then suggested that it would be nice to plant an Avenue of Honor, which was carried out in a very cheerful and spirited manner on Saturday afternoon. Cr Taylor and Mr R. E. Gilsenan occupied themselves during the fore-forenoon in getting the lining-out and other preliminaries ready, but shortly after one o'clock the willing workers could be seen wending their way towards the township, with picks, shovels. &c., on their shoulders, and in a very short time the gang at work was in appearance a very lively and pretty sight, the only thing that was missing was the camera, to have had a few snapshots taken. A little after 3 o'clock Sir William and Lady Irvine, and Mr W. Gray and family, arrived by motor. Cr Taylor then explained that their object in gathering together so hurriedly to plant the avenue was on account of the lateness of the season, and being offered 100 trees, free of charge, by Cr. Wm. G. Gray; of Allwood Nursery, Hurst's Bridge (for which the committee are deeply grateful to him and the public highly appreciate his generous offer). Sir Wm. Irvine then spoke at some length on the ravages of this cruel war, and the good that must result therefrom in bringing all closer together; he also referred to our brave lads who were fighting for us, and thought it was for those at home to show their appreciation by planting the Avenue of Honor. Lady Irvine thou proceeded to plant the first tree, which was an English oak: Sir William following by planting a Spanish chestnut; and Mrs W. G. Gray a sycamore. After that the gathering refired to the entrance of Mr R. E. Gilsenan's green paddock to partake of refreshments, which the ladies had kindly provided for the willing band of workers. Work was again taken to in earnest, and the planting finished, all being satisfied that they had done good work. At the Eltham Shire Council’s monthly meeting held May 6, 1918, Cr. Gray promised to give Council £20 to £25 worth of trees if the Council would plant and guard them. His desire was that a tree be planted in the name of every soldier lad who has gone to the front. Each tree was later adorned with a brass plaque with the name of a soldier and a wooden tree guard placed around them. Over the years many trees died, and following roadworks were replanted on a new alignment. Nillumbik Shire Council is continuing this process of replanting trees in a new alignment to move them away from overhead power lines and to clear the VicRoads reserve. BACKGROUND The Eltham Cemetery is of historic significance to the Eltham area. The Trust was established in 1858 and has administered and maintained the cemetery from that date right up to the present. Among the more noteworthy graves is that of Sir William Irvine, a former State Premier and Chief Justice of Victoria. Eltham Cemetery is surrounded on three sides by urban development. Montsalvat Artists Colony adjoins the remaining (eastern) side. A Joint Select Committee of Parliament called the “Mortuary Industry and Cemeteries Administration Committee" (MICA) enquired into the land requirements at the Eltham Cemetery in 1986. The MICA recommendations contained in its 1986 report are included in the Appendices attached to this report. Although the recommendations have not been adopted by the Government it is interesting to note that the MICA report recommended the use of the bulk of the land for cemetery purpose. In June of 1987, the Cemetery Trust was expanded to include additional members from the Eltham Community by the Minister for Health. At the same time, he instructed the Trust to resolve the land requirement issues. As a result of this Ministerial direction, Tract Consultants has been instructed by the Eltham Cemetery Trust to prepare a report addressing the issues raised in the Minister's letter (see Appendix 1) to the Trust. Principally, the study will examine options available for development of the Cemetery. These options will explore possible boundaries, cemetery design, vegetation, the overall environment, landscaping and financial planning for the Cemetery operations. Appendix 2 details the Cemetery Trusts Terms of Reference for the Study. Before commencing the study in detail, additional basic information was sought; viz: a) sub-soil and rock analysis; and b) feature survey by a Licensed Surveyor. The results from both exercises are included as appendices to this report. Section three includes a summary of the findings along with other analytical results. ADA LAURA LYON Ada Laura Apted was born in 1898 at Queenstown, Victoria the daughter of William Ernest Apted and Sarah Ann Watts On the 2 July 1923 she married David Andrew Lyon at Panton Hill Vic. The Lyon family are well known for the fleet of small buses they ran out of their Eltham Garage. In the interim years between becoming married and moving to Eltham (census records indicate they were there in 1931) they lived in several other suburbs including Doncaster and Ivanhoe At the conclusion of World War 2 the citizens of Eltham decided that a memorial should be made to those of the district who had given their lives during the war. Whilst there had been earlier discussions in 1943 by a body of Eltham Women under the title of "the Women's Auxiliary of the (proposed) Eltham War Memorial Trust'' the first official steps were made on the 27 March 1945 in a meeting by the citizens of Eltham under the title of the Eltham District Progress Association. At this meeting one of the first agenda was the appointment of a committee called "The Eltham War Memorial Trust''. Another was to decision that the Memorial should include: A Baby Health Centre, A Children's Library, And a Pre-School Centre From the inception of the project Mrs Ada Laura Lyon worked tirelessly as a member of the Women's Auxiliary to raise money for the memorial. At the election of the officers of the Trust Council in 1961 she was elected as one of the three Vice Presidents. On the 27 September 1962 Ada suddenly passed away. The news of her death was reported at the following Trust meeting. The President Mrs Morrison voiced the feelings of all present that Ada had done so much for the Trust since its inception and had received the satisfaction of seeing the completion of the three units of the War Memorial Trust which had been her goal. On Tuesday 31 August 1965 the Diamond Valley Mirror reported that on the 28 August 1965 the Eltham War Memorial was transferred from the Eltham Memorial Trust to the Shire of Eltham. A special tribute was paid to the late Mrs Ada Lyon a foundation member who made the Trust her life. A memorial plaque (the sundial) was unveiled in her memory. Ada Lyon was interned at Eltham Cemetery on the 28 September 1962. She was survived by her husband David (who passed away on the 25 November 1975) and their two children Betty and Ian. The Eltham Obelisk was originally located at the corner of Bridge and Main Roads in 1919. In 1943 (WW2) the local community commenced plans to establish the Eltham War Memorial, a living memorial to benefit the children as opposed to a one in stone as per the obelisk. The Eltham War Memorial Trust was established in 1945. In 1947 the Trust intended for the Obelisk to be relocated from Bridge Street and Main Road to the Garden of Remembrance which was planned as part of the Baby Health Centre which was to be the first of three buildings of the Eltham War Memorial to be built in 1951. In 1951 the Eltham RSL was invited to be represented on the Eltham War Memorial Trust. Around this time, with pending roadworks, the obelisk was relocated to the front garden of the Eltham RSL sub branch on Main Road for safe keeping. In 2007, a suggestion was proposed by Harry Gilham (President, EDHS) to John Cohen (ERSL) to claim a special site along with the historic Shillinglaw trees on the now vacant former Eltham Shire Office site adjacent to the Eltham War Memorial precinct for relocation of the obelisk. In 2010 following the financial collapse and sale of the Eltham RSL Sub-Branch property and amalgamation with the Montmorency Eltham RSL sub-branch, the location of the obelisk was again in immediate jepoardy and in conjunction with Nillumbik Shire Council, the obelisk was relocated in front of the Eltham War Memorial buildings in preparation for the Dawn Service on Anzac Day 2012.
