Document - Elizabeth Bright Probate 1905
Tait collection: item 26 of 62 This is a 1905 document containing information on the Will and Probate of Elizabeth Bright, a widow from Ellerslie in Victoria. She died in April 1905 and left real estate to the value of £540 and personal estate to the value of £412. The main beneficiary was her daughter-in-law, Ann Gibson, the wife of William Gibson, a dairyman from Ellerslie. No other information has been found on Elizabeth Bright. The lawyer concerned with the document was Edward Backhouse of Terang. He came to Victoria with his family in 1871 and was educated at Wesley College and Melbourne University. He was the founder and Head Teacher of the Alma Road Grammar School in St. Kilda and later was the Head Teacher of the St. Kilda Grammar School. He also was the Classics teacher at Geelong Grammar School. He practised law at Terang and Yea. This document is of some interest as it gives details on the Will and Probate of Elizabeth Bright who lived at Ellerslie, an area with some associations with Warrnambool at the time. This is white sheet of paper folded in two with hand written material on the four sides detailing the Will and Probate of Elizabeth Bright of Ellerslie, 1905. The pages have printed red lines on three sides. The document has one hand-drawn stamp of the Colonial Bank of Australia of Terang. The written material is legible. Norm was active in workplace disputes during the ALP split in 1955. He was a long time supporter of Ballarat Trades Hall. Julia Gillard was Deputy Prime Minister at the time this photograph was taken. Gillard was a lawyer before entering politics. She was the 27th Prime Minister of Australia from 2010 to 2013 and the first female prime minister. Kevin Rudd successfully challenged Gillard's leadership in 2013 and he went on to lose the election. Julia Gillard resigned from parliament following the leadership challenge. Speaking Made Easy is a registered name of The Penguin Club of Australia Inc which was founded in Sydney in 1937 by women for women. The late M. Jean Ellis O.B.E. was the co-founder of the Penguin Club and developed the organisation in each State and Territory of Australia, and in Port Moresby and Mount Hagen in Papua New Guinea. In an era when women were not so active in public life, one woman’s courage and foresight has inspired members during the decades to continue to support women to develop their speaking skills and become articulate, confident women in all aspects of their lives. Container - Metal Tin for holding documents, late 19th century
This tin or trunk came from the old Kepler Street, Warrnambol Tait legal offices. The tin originally held legal documents connected to John Hyland (1830-1908). Irish-born John Hyland came to the Warrnambool district in 1850 working as a mounted trooper and a rate collector. He then farmed in the Mortlake district for some years before returning to Warrnambool and setting up as an auctioneer and stock and station agent. He was a Warrnambool Councillor (1880s and 90s) and Mayor (1891-2). His trunk of legal documents was first held by the lawyer, Henry Parrington, operating in Warrnambool from 1888 to 1917 (1888-1900 Higgins and Parrington, 1900 Parrington and Tait, 1901-1917 Parrington). Following Hyland's death in 1908 Henry Parrington has used the tin to house his probate documents and when John Sym Tait purchased the Parrington practice in 1917 he has obviously taken over the Hyland trunk. This tin is of some considerable interest as a memento of past Warrnambool identities - John Hyland and Henry ParringtonThis is a metal tin, rectangular in shape. Elizabeth Morrison, was born in 1874 and died in 1963, aged 89 years. Her husband Edward was a porter on the train from Melbourne to Adelaide. Together they had three children: two boys and a girl. The donor's father was the youngest who was born in 1911. The eldest son, Kenneth Morrison, was a Monsignor in the Catholic Church, and an Air Force Chaplain during the Second World War, while the daughter was a spinster who owned a few haberdashery and children’s clothing stores. The donor's father had a newsagency in Bridge Road, Richmond. Clothing - Black Silk Damask Mourning Outfit, c.1898

The donor's father lived until he was 100 years of age.The Fashion & Design collection of the Kew Historical Society includes examples of women’s, men’s, children’s and infants’ clothing from the 18th, 19th and 20th centuries. Items in the collection were largely produced for, or purchased by women in Melbourne, and includes examples of outerwear, protective wear, nightwear, underwear and costume accessories.The costume, which may have been used as a mourning dress is comprised of a matching heavy black silk skirt and top. The styling of the short bodice is accentuated by pleating and by the use of spirals of Parisian jet (black glass beads) on the bodice and cuffs. Chiffon lace is attached to the cuffs and is of the period. The dress is made of silk damask with a woven design of joined lines and circles. The rigidity of the fitted bodice is achieved by the use of baleen and by a heavy striped cotton fabric. The wide skirt, in contrast, has a stiffened brown cotton lining. Book, The England I remember, 1940s
This book has been written by Alan Mickle and tells of his impressions of England in 1908, 1923 and 1938. The proceeds of the sale of the book went to the ‘Food For Britain’ drive, an appeal that operated throughout Australia during World War Two. Alan Mickle, the son of David and Clara, was related to an early 20th century Shire Engineer in the Camperdown area and to Thomas Mickle, a prominent landowner, hotel keeper and photographer in early Warrnambool. Alan Mickle died in 1969. M.E. Clarke, whose signature appears in the book, was a descendant of a local Clarke family which included Angus Henry Clarke (b. 1866) who married Maggie Brown and Angus’ brother, John Sanders Clarke (b.1870) who married Bessie McMahon of Warrnambool. Bessie’s father, William was a prominent 19th century lawyer in Warrnambool. The book was donated to the Warrnambool and District Historical Society by Aileen Hassell who was the daughter of John and Bessie Clarke. This book is significant because of its links to the ‘Food For Britain’ appeal which was active in Warrnambool during World War Two. Also the book is significant because of its links to the Clarke and Mickle families, resident in the Warrnambool district in the late 19th and early 20th centuries This is a soft cover book of 93 pages. The cover is buff-coloured with a fold-in flap at the ends of the cover to make the cover more sturdy. The lettering on the cover is in red and black calligraphy. The book has a Foreword by the Rt. Hon. R.G. Casey and includes several black and white photographs. The cover is a little scuffed and worn. Arthur Henry Schutt. Born 18th July 1912 at Spotswood He was the third child of John Ralph and Mary Jane Schutt. His grandfather was the first librarian of the Victorian Law Courts and his uncle, William Schutt, was a lawyer who later became the Chief Justice Sir William Schutt. His mother was born a Clutha House, stony Creek Yarraville, a was one of ten children. John Schutt opened a chaff mill at the corner of Williamstown and Geelong Roads at West Footscray. The mill was placed on in an old quarry below the ground which saved much of the backbreaking labour of heaving sheaves of hay up into the machinery, the below ground location enable the hay to be fed directly into the railway trucks into the cutters. An elevator then carried the chaff up from the ground directly into the waiting transport, at a great saving in manpower. The chaff mill became on of the largest in Victoria employing more than forty men, and later moved into flour milling.Schutt and Barrie Flour Mills, Melton South site. Document - Robert Cuppage Probate 1904, 1904
Tait collection: item 24 of 62 This is a 1904 document giving information on the Will and Probate of Robert Cuppage. He was a labourer who lived at Woodford and he and his wife, Jane received much sympathy following the deaths from diphtheria of five of their children in 1866. Charlotte (3) and Elizabeth (14) died on 26th August, Robert (6) died on 27th August, Hanne (8) died on 30th August and George (15) died on 14th September. Jane Cuppage died in 1889 and Robert died in December 1903. He left real estate to the value of £240 and personal estate to the value of £5 to his daughter, Margaret Trigg. Ernest Chambers had legal offices in Warrnambool, Port Fairy and Koroit at the end of the 19th century and the beginning of the 20th century. This document was in his possession and it was passed down to successive lawyers occupying the legal offices in Kepler Street and located in this building in 2014 and passed on the Warrnambool and District Historical Society. This is an interesting document as it gives the Will and Probate details of a well-known Woodford resident in the 19th century. It will be useful to researchersThis is a piece of cream-coloured parchment paper folded in two and containing handwritten material on four sides of the paper. It contains details on the Will and Probate of William Charlesworth, 1904. The seal of the Supreme Court of Victoria is attached with green ribbon and there are two purple stamps, one from the Master in Equity of the Supreme Court in Melbourne and the other from the Bank of Australasia in Warrnambool. Letter Books, 1875 - 1945
Eight of these letter books contain letters written by the Warrnambool lawyer George Mackay. They are mostly letters written to contacts while he was living in Scotland and letters sent from Warrnambool to Scotland to his daughter, Margueretta (Meta) who was studying medicine. Scottish-born George Sutherland Mackay (1850-1926) opened a legal practice in Kepler Street, Warrnambool in 1891 and in 1893 bought the business of the late James Fletcher, with the business known as Fletcher and Mackay. In the 1920s John Taylor became a partner and the firm of Mackay, Taylor & Co. (later Mackay Taylor) continued until 1999 when it merged with Taits Solicitors to form Tait Taylor (now Taits Legal). George Mackay was a Warrnambool Councillor and the first Mayor to hold office for four successive years. He was instrumental in getting the Warrnambool High School established and was the Chairman of the first School Council. Two of these letter books contain letters written by Ernest Powling. One letter book contains letters written by James Mack, a Warrnambool accountant These letter books are of considerable importance as they contain letters relating to legal matters in Warrnambool and district from the late 19th century to the mid 1940s. The letters also give an insight into the private life of a prominent Warrnambool lawyer, George Sutherland Mackay..1 This letter book has a dark blue cover, brown leather binding, an alphabetical index with tabs and handwritten letters. The spine is damaged. .2 This letter book has a dark red cover with red binding, an alphabetical index with tabs, a handwritten label on the front cover, information on the ledger maker and the handwriting of the letter writer inside the front cover. Bank Books (2), 1930s
These items, 1930s bank books belonging to Michael Toohey, a Woodford farmer, come from the estates of the Ardlie family of Warrnambool and appear to have been stored amongst the office material of the prominent Warrnambool lawyer, William Ardlie (1843-1933). He was the son of pioneer Warrnambool settlers, John and Mary Ardlie. William Ardlie established a legal practice in Warrnambool in 1867, initially in partnership with George Barber. Ardlie was a dominant figure in legal and community circles in Warrnambool and continued with his legal practice until the early 1930s. The bank books were issued by the Commercial Banking Company of Sydney. A Warrnambool branch of this bank was established in 1927 when it acquired the Bank of Victoria. The Warrnambool branch of the Bank of Victoria at 92 Liebig Street then became the Commercial Bank of Sydney. In 1958 the bank building was demolished and new premises were built. In 1981 the Commercial Bank of Sydney merged with the National Bank of Australia and traded as the National Bank in the building at 92 Liebig Street until the premises were closed in 1985.These items are of minor interest as mementoes of the Warrnambool branch of the Commercial Banking Company of Sydney..1 A bank book with a hard black cover and pages containing ruled black lines. Betty Borchers worked as a legal secretary. She was active in the Ballarat ALP and is the wife of Norm Borchers. Joan Brown was a passionate and active member of the Labor Party in Ballarat. Lindsay Tanner was a member of the House of Representatives holding the seat of Melbourne for the period 1993-2010. He resigned from politics prior to the 2010 election. He is a lawyer who has worked as an articled clerk and was State Secretary of the Clerks Union before entering politics. He was Minister for Finance during the Rudd-Gillard years of government. Photographs x 2 - Afternoon tea visit to Towong Hill
Towong Hill Homestead is a 110-year-old Federation style mansion situated on a rock outcrop, with views of about 260 degrees. It was built over 2 years by grazier Walter Mitchell from bricks made from local clay dug from the river bank, to be the family home for his new bride Winifred. They established their home in 1904. After the death of Walter in 1917, Winifred relocated her family, but the homestead remained in the families hands. In 1935, Thomas Mitchell (1906-1984) returned home to Australia, a successful Lawyer, and married city girl, Elyne Chauvel, and settled himself back at his childhood home, Towong Hill. Thomas was a world champion slalom skier, had been a prisoner of the Japanese at Changi, and was elected for the Country Party in 1946 and served as attorney-general in the McDonald government. His wife Elayne (1913-2002) is best remembered for her Silver Brumby series of novels for children. But Elyne also wrote a substantial number of non-fiction works about the Snowy Mountains. This is a de-luxe edition of a 1984 facsimile publication of Edward Vidler’s 1907 book, ‘Sixty Years of Progress’. The facsimile book was published by the Osburne Group, a group of three Warrnambool men who reproduced several books that were out of print but were important in Warrnambool’s history. The facsimile book features the photographs and text of the original 1907 book alongside photographs and text concerning Warrnambool in the 1980s. J.B. Dwyer, who was given this de-luxe edition, was a prominent 20th century lawyer in Warrnambool. The original Edward Vidler book was produced to mark the sixty year anniversary of the founding of Warrnambool. It is a very rare book today but it is very important because it featured many photographs hitherto-unpublished and an accompanying text that is deemed today to be very accurate in historical terms. Edward Vidler, a publisher, writer, journalist and editor, was in Warrnambool in the early 1900s and, through his membership of the Warrnambool Progress League and the Chamber of Commerce, was responsible for initiating many improvements in the town and he was also responsible for organizing the making of the Pioneer Honour Board with its portraits of 204 pioneer men in the Warrnambool district.This book is of interest as a de-luxe edition of the 1984 facsimile publication of the Edward Vidler book, ‘Sixty Years of Progress’, a 1907 book on Warrnambool’s history. The reprinting of Vidler’s book enabled many researchers and others interested in Warrnambool’s history to access the Vidler information more easily as it is now rare to find a copy of the original Vidler book. Caul associated with Private R.P Holbery, World War I
Label written by Dr Frank Forster documents that this item belonged to Private RP Holbery, who carried the caul as a good luck charm when he served in the Australian Imperial Forces (AIF) during WWI. Refer to supplementary file for War Records at Cat no: 34 A caul is a small slightly yellow coloured membrane that can cover the newborn baby's face. After birth, the caul can be removed and laid on a piece of paper to dry. Superstitions regarding cauls are very ancient, and believers in superstition thought that babies born with a caul would never drown. They were traditionally sold to sailors to bring good luck. Lawyers or advocates in the legal profession would buy cauls as they believed it would confer the "gift of the gab". Cauls were also carried by servicemen during the early part of the 20th Century. World War I pushed up the price of cauls. They were often carried in silver cases engraved with commemorative inscriptions. Other names used for a caul are "Coif", "Sillie", "How" (Hood) or "Hallihoo" (Holy Hood).Caul, consisting of yellowed membrane in two pieces. According to the State Library of Victoria catalogue the work is an over-painted photographic print, photographed by an unknown photographer from the painted canvas by Izett Watson and Thaddeus Welch, which was exhibited as a painted cyclorama in the 'Battle of Waterloo' Cyclorama building, Fitzroy, ca. 1891. This is based on the evidence that the pulleys and brick wall are discernible at the top edge of the image which B. Ireland has not over-painted. This artist may by Beryl Ireland, who was a miniaturist and studied at the National Gallery of Victoria Art School in the 1870s. Typewriter Mechanical Portable, 1950s
The Olivetti company was founded in Italy in 1908.This particular typewriter is a Olivetti Lettera 22, oblique front stroke and portable manufactured after 1950. The 1950s and 1960s was a time when British manufactured goods were still purchased by many Australian consumers. The later 1960s onwards, there was a shift, mainly in the cities, to European made goods. The invasion of Japanese manufactured goods was relatively slower, especially in rural areas. The demand for long lasted and dependable merchandise was in the rural area still the most important criteria. The ease of setting up this typewriter and its compact mobility was its major benefit to trades people and travelling professionals, e.g. rural doctors, other medical professionals, accountants, lawyers and educators. This item facilitated the growing numbers of professional nomads requiring a relatively light office stationery package e.g. travelling novelist, writer, businessman and academics. This typewriter needed no electrical or battery power to operate it. Outback Australia, where at this point in time, was still relatively isolated from a good available electrical power reticulation and battery power, and therefore could not be totally measured as a highly efficient office environment.Although this typewriter was purchased from a business in Penrith, Sydney, N.S.W., it is significant that it travelled easily to the Kiewa Valley, demonstrating the mobility of certain sections of the community. This typewriter was designed by an Italian industrial designer, Marcello Nizzoli, in line with the art deco style of the 1930s and the colour and flexibility of the vibrant 1950s. The underlying theme of manufacturing in the 1950s was to produce equipment that was more efficient than what was inherited from the earlier period of 20th century. Improvements were made to this Olivetti typewriter by Giuseppe Beccio by reducing the number of parts made from 3,000 to 2,000. This reduction of parts and therefore cost of production was the major principle of the Japanese manufacturing juggernauts of the post World War II era. Efficiency and low costs material was becoming prime factors in the success of rural industries from the 1960s. Competition from overseas producers was starting to affect rural industries and the removal of the large range of tariff protection, especially rural products, required not only a shift of farm management but a more efficient cost savings modus operandi. This Olivetti Lettera 22, oblique front stroke portable (weighs 4kg) mechanical typewriter has a coral coloured plastic casing. The keys are made of black hardened plastic with white lettering, numbers and symbols (imperial fractions, and pound). It has a QWERTY keyboard as opposed to the Italian QZERTY. It has a lever to move the ribbon between black, neutral (for mimeograph stencils)and red colours (a red key is provided for highlighting specific words,letters or symbols) . This machine is fitted with only a black ribbon. It has a black rubber paper rollers and chromed metal parts on the carriage way. It has four rubber feet underneath the main body. On the left side of the roller there is a lever to adjust the roller from fixed (when mobile) through 1,2 and 3 line space gradients. The Osburne Group was was three people, headed by Warrnambool Lawyer Dan Madden, who in the 1980’s republished a few local historical books. Collingridge’s (1847-1929) book ‘The Discovery of Australia’ was a work which supported the ‘legend’ of a Portuguese voyage of exploration, which led to the loss of one of its ships in 1522, believed to be the Mahogany Ship, on the coast south of Tower Hill. Hence European charting of the east coast of Australia centuries before Captain Cook, which the British historians viewed almost as heresy. TheOsburne Group acquired copies of Collingridge from the publisher, and saw that they were made available as a historical record supporting the research of Ken McIntyre, who in 1981 published separately a book called ‘The Secret Discovery of Australia’. The first book by the Osburne Group was republished in facsimile. It was the ‘History of Warrnambool’, collated and printed by Richard Osburne in 1887 after he had sold his newspaper the Warrnambool Examiner to Fairfax, which took up the name of Warrnambool Standard. Hence the name Osburne. A framed photo of the first president of Melbourne Legacy, Legatee Harold Cohen. Harold Edward Cohen (1881-1946), soldier, lawyer, politician and businessman, was born on 25 November 1881. In 1901 Cohen was commissioned in the Field Artillery Brigade, Australian Military Forces, and was promoted captain in 1905 and major in 1909. In 1915 he was appointed commanding officer of the 6th Army Brigade, Australian Field Artillery Regiment, Australian Imperial Force, with the rank of lieutenant-colonel, serving in the Middle East, England and France until June 1919. Twice wounded and twice mentioned in dispatches, he was awarded the Distinguished Service Order in 1917 and created C.M.G. in 1918. He was awarded the Volunteer Decoration in 1921 and the CBE in 1934. In 1929 Brigadier Cohen entered Parliament as the member for Melbourne South in the Legislative Council, and in 1935 transferred to the Assembly as member for Caulfield, which seat he held until 1943. During the Second World War Brigadier Cohen served in the Middle East as honorary Red Cross Commissioner overseas. This collection of papers have come from the offices of William Ardlie a local solicitor. He was born in Moonee Ponds in 1843 and was admitted as an attorney and solicitor of the supreme Court in 1865. From 1867 to 1878 he was in partnership with George Barber and then continued to practise until his late eighties which made him the oldest practising lawyer in Australia. He was involved in local councils and organisations such as the Hospital and Anglican Church.He was associated with several large homes in Warrnambool including Wyton presently the home of Emmanual College Warrnambool. He died in 1933.His son E L Ardlie also practised as a solicitor from the same offices from 1893. A number of the invoices included relate to the Estate of James drought who was a local policeman and owner of a number of properties and operated in various trades such as George Ramsay manufacturer of stoves and chimneys, J Rogers plumber & gas fitter and Christian & Dodds who were carpenters and joiners. There are a number of documents which relate to the Chinese, many of whom operated market gardens along the Merri River. They were a familiar part of Warrnambool from around 1872 until around 1940. The names mentioned in these documents include Ah Foo,Charles Quing Bow, Andrew Quing Bow Ah Bing Ah Jing Ah Moon and Ah Seong. They were reknown for their supply of fresh vegetables to the people of the town. They leased land from John Moore. These documents are a cross section of the types of documents which were used and are still used in the operation of businesses. They provide a social snapshot of people and the business which they conducted with their solicitors in this case William and E L Ardlie who were a long standing legal firm in the district. A portrait of Legatee Harold Edward Cohen CMG, CBE, DSO, VD, MLC, he served in both World Wars, attained the rank of Brigadier. He was the first president of Legacy in 1923 to 1924. The portrait was in an album of photos taken in the 1940s (mostly 1945). Harold Edward Cohen (1881-1946), soldier, lawyer, politician and businessman, was born on 25 November 1881. His early interest in soldiering led to him being first commissioned in the Australian Military Forces in 1901 in the Field Artillery. On the outbreak of the First World War he took overseas the 6th Australian Field Artillery Brigade, seeing service in France and Egypt, and being awarded the CMG and DSO, and being twice mentioned in despatches. He was twice wounded in action. He was awarded the Volunteer Decoration in 1921 and the CBE in 1934. The Bow Tie is a type of men's necktie that consists of a ribbon of fabric tied around the collar in a symmetrical manner such that the two opposite ends form loops. Ready-tied bow ties are available, in which the distinctive bow is sewn and a band goes around the neck and clips to secure. Bow ties may be made of any fabric material, but most are made from silk, polyester, cotton, or a mixture of fabrics. The Bow tie originated among Croatian mercenaries during the Prussian wars of the 17th century when the Croat mercenaries used a scarf around the neck to hold together the opening of their shirts. This was soon adopted under the name cravat, derived from the French for "Croat", by the upper classes in France, then a leader in fashion, and flourished in the 18th and 19th centuries. The most traditional Bow ties are usually of a fixed length and are made for a specific size neck. Sizes can vary between approximately 14 and 20 inches just like a comparable shirt collar. Fixed-length Bow ties are preferred when worn with the most formal wing-collar shirts, so as not to expose the buckle or clasp of an adjustable bow tie. Bow ties are worn by magicians, country doctors, lawyers, paediatricians, professors musicians and by people hoping to look like the above and clowns also wear oversized ones. In the 1980’s fashionable and professional women wore a type of Bow tie. Most men only wear Bow ties with formal dress.
