William Rae (1823-1887) was born into a farming family in Scotland and came to Australia in i852. After coming to the Bendigo area, he established a puddling machine in American Gully. He then bought a claim on the Victoria reef and was quite successful. Subsequently he bought a steam engine and three batteries to begin crushing quartz. This was such a boon that he moved to a more convenient location in Happy Valley, where he set up a crushing battery with 35 heads.Sketch of a crushing works. Printed underneath is: Wm. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. April 1868' Attached to plan is a letter report accompanying plans on the underground workings in (illegible) Ballerstedt & Sons, Victoria Hill (ink blot covering writing RH side) Text of letter begins : the underground level southwards from the shaft is 4ft 6' x 6 ft wide as shown on the plan; and is at a depth of (illegible) from the surface; along the (illegible) of which the timbering both upright and cap-pieces; are now in as good condition as when the work was being proceed with; with the exception of the uprights and one cap-piece which are slightly crushed from the general settlement of the mullock. The timbering of the drives is still standing in the same position though upwards of 12 months has elapsed after the slip in the open cutting had taken place, showing very clearly in my mind that the slip could not be attributable to the insufficient timbering of the underground workings; but rather to the action of the weather in this particular part of the cutting. The probably quantity of mullock that was detached or slipped from the west side of the cutting; would be (from careful enquiry and observation ) about 1500 loads at least; enough to crush the whole of the timber in the levels, if it had not been of the most substantial character and I think yours to prove that the fall was not caused by any defective timbering but from the cause already stated. Listed in "The Bendigo goldfield registry" 1872 as Royal Oak Company: Bignell's Reef, Derwent Gully. Capital £24000., in £24,000 20s. shares. Manager, W. Barker. Newspaper articles dating from 11 Jan 1867 refer to the company as "Royal Oak Mining Company". Both names appear to be used interchangeably. This A3 document is made up of 3 pieces of heavy stock lined paper. The document is bound on the left side with glue and string creating a book which comprises the legal contract of mortgage for mining equipment. The document is handwritten in black ink across 4 pages (2 double sided pages) with the last page acting as the documents cover when folded down into a pamphlet. The signature page includes 9 red wax seals. When held up to the light, the cover page and internal page show an indentation reading G. Wilmot 1862. Two copies of document : nineteen handwritten pages of notes on 'The Rich Victoria Hill and Its Historical Association' Signed by A Richardson and dated 30 - 8 - 1971. and a typed copy of same. Notes include: Introduction, Hotels, Mines, Mining History and descriptions of features where the signposts are. Mines mentioned in the text are: North Old Chum. Ballerstedt's first open cut, Lansell's Big 180. 20 head stamper, Lansell's Cleopatra Needle, Victoria Quartz Mine. Cleopatra's Needle was a square sectioned brick chimney with this four sided pyramidal chimney top with four vents to allow the smoke to escape whatever the direction of the wind. It was demolished in the 1950's as it had a bend in it and it was considered unsafe. Lansell had two other mines with similar chimneys, the '222' in Chum Street and his 'Sandhurst' or 'Needle' mine near the Bendigo, Eaglehawk boundary. Three page document hand written by Albert Richardson, on the history of Victoria Hill, Ironbark. 'one of the richest areas on Bendigo field. In the first six years, £1,200,000 worth of gold was obtained. Almost every claim returned a fortune.' Page three title: Other features on Victoria Hill. 'Adjacent to Central Nell Gwynne area as the mining museum. Adjacent to the New Chum Hill on direct south side of the Calder Highway. This hill reached by a short and excellent access road gives a magnificent view of Bendigo and Golden Square, and a very good view of another tourist attraction, Lansells 'Fortuna' now Survey Regiment's headquarters. This hill is the centre of another rich area. The Lazarus mine 3,360 feet deep with 24 saddle reefs in 2,200 feet. The New Chum United, Lansell's 222with its 120 ft high poppet legs. Crotonhurst was the estate of Mr William F. Langdon and his wife Sophia, the daughter of judge George H.F. Webb. A drawing room meeting was organised here by the Ladies' Harbour Lights Guild on 13 July 1926 hosted by Mrs Langdon. In an article published in the Australasian on Saturday 24 July 1926 we could read: " A drawing room meeting in connection with the Victoria Missions to Seamen took place on July 13, at Crotonhurst, Caulfield, the picturesque home of Mrs. W. F. Langdon, when the chaplain to the mission (the Rev. J. R. Weller) and other speakers explained the purpose of the Ladies' Harbour Lights Guild, and urged its claim to interest and support from the people of Victoria. The chair was taken by the mayor of Caulfield (Councillor Page), who spoke sympathetically of the fine work being carried on "week-in week-out" by members of the guild. The honorary treasurer of the guild (Miss Tracy) spoke of the need for more annual subscribers." This Holy Bible is entitled "The Holy Bible containing the Old and New Testaments, translated out of the original tongues: and with former translations diligently compared and revised by His Majesty's Spiritual Command." It was printed by Sir D. Hunter Blair and M.T. Bruce in Edinburgh, 1836, printers to the King's most Excellent Majesty, H.B.S." The Bible belonged to David and Alice Ellis, a young couple married in Dublin in 1855. It has been handed down in the Ellis family until it was donated, together with other personal effects, in 2004 by David and Alice’s granddaughter, daughter of David Ellis Junior. Alice treated the Bible as an important posession. On 6th October 1855 newlyweds David and Alice Ellis set sail for Australia in the brand new Schomberg, considered the most perfect clipper ship. She was built as an emigrant ship in Aberdeen and set sail from Liverpool on her maiden voyage, bound for Melbourne, Australia. She was loaded with 430 passengers plus cargo that included iron rails and equipment intended for building the Geelong Railway and a bridge over the Yarra from Melbourne to Hawthorn. On 27th December 1855, only one day from her Melbourne destination, the Schomberg was grounded on a sand-spit on the Victorian coast near Peterborough. The passengers and crew were all safely rescued by a passing small steamer, the SS Queen, which traded between Melbourne and Warrnambool, and taken to Melbourne. The passengers had been told, when leaving the sinking Schomberg, that all they could take with them was a small basket or handbag. A newspaper article later mentioned that one of the things Alice made space for in her basket was her Bible. (It is unclear whether Alice took any possessions with her onto the SS Queen, but a note accompanying the donation of the Bible and basket states that the items were “left on deck and salvaged as Schomberg went down”.) Another steamer was despatched from Melbourne to retrieve the passengers’ luggage from the Schomberg and Alice was reunited with all of her boxes of belongings. Other steamers helped unload the cargo until the change in weather made it too difficult. Although the Schomberg was wrecked there were no lives lost. At that time David was 23 years old (born in Wales, 1832) and his new bride Alice was 26 (born in Dublin, 1829). They had been given letters of introduction to people in Tasmania so they travelled there from Melbourne. However the couple only stayed on that island for about a year before they returned to the Western District of Victoria. David worked for Mr Neil Black as a gardener for a while then, when the land in the area was made available by the Victorian government, David and Alice claimed a selection of land on Noorat Road in the Terang district. They settled there for the remainder of their lives, expanding their property “Allambah” as opportunities arose. A document accompanying the donation lists the names of six children; William, Grace (c. 1859-1946), Thomas (c. 1866 – 1939), David (c. 1962 – 1953), James and Victor. David died on 13th April 1911, aged 79, at their property. Alice passed away the following year, November 1912, aged 83. Alice’s obituary described her as “a very homely, kindly-natured woman, who was highly esteemed by a large circle of friends; and she was also a firm adherent of the Presbyterian Church”. At the time of Alice’s death she left behind three sons and one daughter. Her daughter Grace Ellis was also a very active member of the Terang Presbyterian Church and a member of the PWMU (Presbyterian Women’s Missionary Union). She was also involved in the Red Cross and other charities. Grace passed away in 1946, aged 87. This metal travelling trunk belonged to David and Alice Ellis, a young couple married in Dublin in 1855. The metal trunk was also amongst the couple’s possessions, along with a pair of candlesticks and a Bible. Their trunk was later retrieved from the ship’s deck by the crew of a steamer sent from Melbourne. At that time, David was 23 years old (born in Wales, in 1832) and Alice was 26 (born in Ireland, 1829). The couple lived in Tasmania for a short period before settling in the Western Districts of Victoria. David worked as a gardener and, when land in the area was available to purchase, David and Alice claimed a selection on Noorat Road near Terang. They settled there for the remainder of their lives, expanding the property that they named, ‘Allambah’, and had six children. The relationship of the objects in Flagstaff Hill’s Schomberg collection allows has potential interpretation of the story of the Schomberg. The collection of objects is archaeologically significant as the remains of an international passenger ship, as it represents aspects of Victoria’s shipping history, in addition to its association with the shipwreck and the ship.Traveller's metal trunk; small brown woodgrain patterned trunk with dark red features and brass lock. This well-made strong and sturdy piece of secure hand luggage has rounded corners and sides, with the ends of the lid slightly bulbous. The lid is reinforced inside across the centre. The lid and sides have dark red metal D-shaped handles that fold down. The two hinges on the lid have their fittings inside the trunk which is hinged across the back. Two dark red painted latches secure the front along with a brass rod and lockable latch in the centre front. The metal is shaped with a group of corrugated ribs on each side of the centre, around the trunk. A white printed and lacquered label is inside the lid and has additional handwritten text. The truck was the luggage of David and Alice Ellis on the sailing ship SCHOMBERG in 1855. Printed on the label: "B B BRAND./ These Goods are manufactured of the best / steel sheets, and are guaranteed to give every / satisfaction, and will last for years."
