The Argus reports that “In 1916 the members of the bar took the opportunity afforded by his [a’Beckett’s] 80th birthday, and the completion of 30 years on the bench to present to the judges of the Supreme Court, with his permission a portrait of himself, to be placed in line with portraits of other judges in the Supreme Court library. The portrait which depicts Sir Thomas a’Beckett in his robes, was an excellent piece of work of Mr Max Meldrum. The unveiling was made the occasion of a little demonstration at which some congratulatory speeches were made." Sir Thomas a'Beckett arrive in Melbourne as a teenager with his parents in 1851. His uncle was the former Chief Justice, his father a well known solicitor. At the Bar Sir Thomas mainly worked in the Equity jurisdiction, which he took as a specialisation with him to the bench. This is an early work of Meldrum, he won the Archibald prize for portraiture in 1939 and 1940.The portrait is of interest for whom it portrays and as the early work of a well known artist.A full length portrait in oils of Justice Sir Thomas a'Beckett. Sir Thomas is seated, his feet placed on a plush red foot stool. He is dressed in his red judicial robes with white fur trimming and black trousers and a full bottomed wing. He sits in a fine carved wood and leather chair, in the background a gold frame is just visible. A line in the canvas indicates that the size of the painting was expanded. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. This portrait bust, along with that of Redmond Barry, was purchased in May 1884, The library still holds the receipt, but there is very little other information. It was probably a part of the program of outfitting the library interiors. Justice Fellows (1822-1878) was only a judge of the Supreme Court for six years (1872-1878), he had a long career in colonial politics. James Scurry (1826-1894) worked in architectural sculpture after migrating from England.The bust of Justice Fellows is of some interest as part of the original furnishings of the library. Elizabeth Avis- Box 1835-1913 was born in Sussex, married William Box in 1854 and arrived in Melbourne in 1855. William’s parents George and Mary Box and his siblings sailed with them. William & Mary at first leased land in the area of the ‘Dendy Special Survey Brighton 1841’ and then purchased the property with the pioneer cottage 1868 & 1869. William & Elizabeth established a market garden and raised 13 children. 1888 they built a larger 2nd house in front of the original cottage. William died in 1902 and Mary sold 9 acres in 1908 to W. .Snowden Anderson – it later became Joyce Park where the reconstructed Box Cottage Museum now stands. After Elizabeth died her daughters Ada and Violet lived on the 1 acre property until 1917 when August Reitman, a potter and monumental mason, leased the house and land. He established his pottery business and purchased the property in 1935. The business moved in 1953 but continued to use the cottage as a workshop/ storeroom until it was sold to Lewis Timber P/L in 1970. Elizabeth & William Box settled in the pioneer Cottage in Jasper Road East Brighton 1868 and established a market garden whilst raising their 13 children. This Cottage was reconstructed in Joyce Park, Ormond 1984 and is the home of City of Moorabbin Historical Society. This painting was created by Robert Dowling (1827-1886) in 1885. At this time Dowling was considered Australia's best portraitist. Dowling had been born in England, but migrated to Van Diemen's Land in the early 1830s with his parents. Dowling worked in both Tasmania and Victoria as an artist, before returning to England in 1857. He did not return to Australia until 1884 and received eighteen commissions for portraits. The Barry portrait was commissioned after Barry's death which explains some of the mistakes in the depiction of Barry's robes; the fur cuffs and collar are too large, and the cummerbund is sitting in the wrong place. Sir Redmond Barry is an important figure in Colonial Victorian History, responsible for the establishment and support of some of our finest cultural institutions (the University of Melbourne, the State Library of Victoria, the Supreme Court Library, and aspects of the Museum of Victoria's collection). This is in addition to his role as barrister defending aborigines in the 1840s and his position as a foundation judge of the Supreme Court of Victoria, a position he held for nearly 30 years, presiding over two of the most well known of colonial trials: the Eureka Trials in 1854 and the Kelly trial in 1880.The portrait of Sir Redmond Barry is significant because of the historical importance of Redmond Barry in colonial Victorian history. Marong was first incorporated as a road district on 27 August 1861, and became a shire on 23 December 1864. On 1 October 1915, the Borough of Raywood, which was gazetted on 17 January 1865 on 23.31 square kilometres of land 28 kilometres north of Bendigo was united with Marong. On 1 October 1990, the Shire of Marong became a rural city, under the Local Government Act 1989. In a report on 17 February 1994, the Local Government Board recommended that the five councils in the Bendigo region merge to form a "super city", with a population of about 81,000. Marong, Eaglehawk and Huntly had earlier objected to the proposal, and the Board noted a weak no vote against the merger proposal in a referendum in the region; about 70% had voted against, but with a turnout of between 30% and 40% of eligible voters. The three councils filed a writ in the Supreme Court, alleging failure to follow process by the Minister for Local Government, Roger Hallam, but by the time the new "super city" was announced, the writ had not yet been heard, and on 24 March 1994, the Rural City of Marong successfully applied for an injunction blocking the publication of the gazette the following day abolishing the five councils and appointing three commissioners. The government responded by introducing legislation, the City of Greater Bendigo Bill 1994, to Parliament, to effectively override the Supreme Court action, with Hallam saying "the bill would make clear that the Government is determined to achieve its objective for a more efficient municipal structure for the Bendigo region." Marong mayor Robert Hynes described the action as "terribly disappointing", adding, "One way or another, I believe it does mean an end to our fight... it seems the Government are above the law to me." On 6 April 1994, Marong voted to drop the Supreme Court action, effectively in doing so voting itself out of existence, and on 7 April 1994, the Rural City of Marong was abolished, and along with the City of Bendigo, the Borough of Eaglehawk and the Shires of Huntly and Strathfieldsaye, was merged into the newly created City of Greater Bendigo. This bust was commissioned and made in the years before Holroyd's retirement from the bench. It is not known precisely when the bust entered the Library collection or the circumstances of its execution and commission. Justice Holroyd (1828-1916) was a judge of the Supreme Court for 25 years, after a successful career at the bar. Charles Web Gilbert (1867-1925) was a largely self taught sculptor, only tackling the medium of marble in the years before World War One. After the war he made a number of War Memorials, but his best known work is his statue of Matthew Flinders, the explorer, in Swanston Street.The portrait of Justice Holroyd is of interest as an unusual depiction and commemoration of a Judge. Kralcopic Pty Ltd, was a subsidiary of Bendigo-based company GBM Gold and had previously held mining licences around Bendigo, which incorporated sites including Kangaroo Flat, New Moon, Eaglehawk and the associated Woodvale Evaporation Ponds Complex. In August 2019, the Earth Resources Regulator decided not to renew Kralcopic’s three mining licences, due to the company’s inability to provide surety that it could finance its mining activities and site rehabilitation obligations. In October 2020, the company filed legal proceedings in the Supreme Court challenging the decision not to renew these licences. The Supreme Court later upheld the regulator’s decision not to renew the licences. On 23 April 2021, the Federal Court of Australia appointed KPMG as Kralcopic’s liquidators. On 14 May 2021, the liquidator lodged papers with the Australian Securities and Investment Commission (ASIC) to disclaim Kralcopic’s freehold land at Woodvale and parcels of land around the company’s former Bendigo sites, with the land to subsequently become Crown land. The Earth Resources Regulator has put a statutory exemption in place to preclude new mining licence applications on the sites while we undertake rehabilitation. The exemption also provides an opportunity for government to consider future uses of the sites in consultation with the City of Greater Bendigo and the local community. These are personal documents that belonged to Henry Roberts Parrington. They include statements regarding his preliminary and final examinations that qualified him as a lawyer in England (1867, 1873), annual certificates of registration as a lawyer in New Zealand (1876-1886), personal affidavits presented to the Supreme Court of Victoria and permission to practise as a lawyer in Victoria (1886). Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in Melbourne in 1926. These documents have some significance as they are original papers documenting Henry Parrington’s early years as a lawyer. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries. These sixteen paper documents relate to the lawyer, Henry Roberts Parrington. They are all original documents from England, New Zealand and Australia (Victoria). Most have printed material on them. All have statements and information handwritten in black ink and many have stamps relating to the country concerned. Some are foolscap size and are printed on blue paper. This certificate, drawn in a very elegant hand, contains the biographical information of Wilfred Busse. It is assumed to be a funeral or memorial card. Born in Chiltern in 1898, Wilfred Clarence Busse was educted at Wesley College and then the University of Melbourne. He became a barrister and through his time at the University of Melbourne studied with future Chief Justice and Governor of Victoria Sir Henry Arthur Winneke (1908–1985), as well as spending time in the chanbers of Sir Leo Finn Bernard Cussen (1859-1933), who was a judge of the Supreme Court of Victoria. Busse also wrote two novels, 'The Blue Beyond' and 'The Golden Plague'. In 1931, 'The Golden Plague' was awarded the T. E. Son of Mr. W.H.Shaw the Managing Director of the celebrated Phoenix Foundry which played such an important part in the early industrial history of Ballarat and who lived all his Ballarat life in a house in Armstrong Street South not far from Dana Street. Born in Ballarat on 15th October 1862 and attended Ballarat College 1870-1877. Was articled to Hardy and Madden of Ballarat Solicitors. Practised as a Solicitor in Ballarat for some years. Went to Western Australia in 1897 and acted for a time as Deputy Master of Western Australia Supreme Court. Was for some time partner with Drake Brockman now a judge but latterly practised as Shaw and Shaw in partnership with his brother Frank as Solicitors at 81 St. Georges Terrace, Perth, Western Australia. Example of prize ordered from London where they were specially bound and embossed with the College crest. Awarded by F J Thomas B A, principal under unusual circumstances 1874 - 1876.Preface dated 1859. The Working Men’s College was founded in 1881 by a prominent grazier and philanthropist, The Hon. Francis Ormond, who donated £5000 towards the establishment of the college. The Council of the Melbourne Trades Hall then matched Ormond's initial donation by rallying its members. On 4 June 1887, the college opened in its purpose-built building on the corners of Bowen Street and La Trobe Street in Melbourne, with a gala ceremony. It became the third official provider of higher education in the new Colony of Victoria (the Melbourne Athenaeum was founded in 1839 and the University of Melbourne in 1853). The college was the predecessor to the current-day Royal Melbourne Institute of Technology (RMIT University). Adjoining the college in the 1890s were the Supreme Court of Victoria (later the Melbourne Magistrates' Court) and the Melbourne Gaol - both which are now part of RMIT today. Harriet Cecilia Hordern Williams (1889 - 1968) was the grand-daughter of William Hordern (1830 - 1881) and Cecelia Monger (1830 - 1914). William Hordern was the sixth of seven children of Anthony Hordern Snr. who established the Anthony Hordern & Sons department store in Sydney which operated from 1923 to 1970. Harriet's mother Cecilia (1854 - 1934) was married to Christopher Williams. Harriet's uncle William was appointed commissioner of the Supreme Court of South Australia in 1903. Her cousin Doris Amelia Hordern (1889 - 1970), as Doris Blackburn won the Federal seat of Bourke in 1946 following the death of her husband who had previously held the seat. This branch of the Hordern family has a strong connection to Hawthorn through their home "Stramshall" in Auburn Road Hawthorn and also with the Auburn Baptist Church. Harriet Williams enlisted in the Australian Army Nurse in December 1916 and served as a Staff Nurse until her marriage in London in 1919. This certificate is significant to the history of Hawthorn and Australia through its connection with the Hordern family, the home Stramshall in Hawthorn and with the Auburn Baptist Church. It is significant to the history of the Royal Children's Hospital Melbourne as an example of early 20th century training protocol, in the persons who signed the certificate and the photographs of the hospital buildings of that time.
