Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. In 1993 Eltham Shire Council issued a permit to Michael Muzur, Terry Lant and Andrew McMillan to redevelop the former Montmorency Theatre/Bingo Hall at 41-43 Were Street as an alcohol-free youth entertainment centre. Ron McCormack, retired former JP on behalf of 41 Joint Appellants consisting of local residents and traders successfully lobbied the community and won an Appeal to have the permit cancelled as unsuitable development. The Administrative Appeal Tribunal found that the proposed development came withing the Eltham Planning Scheme definition of an 'amusement parlour' and that the playing of pool an amusement machines would be the focus of the centre and unlikely to attract older age groups. The tribunal was not satisfied the applicants had sufficient knowledge or where with all required for the successful running of this type of operation. With respect to the objectors, the Tribunal did not accept that a responsibly managed and attractive amusement parlour could not coexist near the adjoining residential area and without detriment to the commercial centre. At a Council meeting on June 7, 1994 councillors requested a report outlining criteria to be used to assess planning applications for youth entertainment venues given the Tribunal's view that a poorly managed facility in a small neighbourhood shopping centre, particularly in such close proximity to a residential area would not only have the potential to increase perceived youth problems, but could jeopardise the prospects of future proposals. Shire of Eltham Archives: Series 69, Item 7 Opens with aerial views of the Shire, 85% of the shire covered by the Green wedge principal. Discusses the obligations required of the Shire to maintain the Green Wedge. The Shire covers over 27,000 hectares with a population in excess of 45,000 residents, more than 70% living in the southern 10% of the Shire in suburbs of Eltham, Montmorency, Lower Plenty and Research. 85% of the Shire in the more sparsely populated northern area which is covered by the Green Wedge. Council is committed to providing a parity of services to all residents such as garbage collection and maintenance of roads. Views of rubbish collection trucks in Montmorency. It is emphasised that the cost of these services in highly populated areas is relatively low whereas in the sparsely populated Green Wedge areas, considerable. There are hundreds of kilometres of roads throughout the Shire, many unmade and maintenance is high to check overhanging trees and erosion especially on the steep hills is expensive and disproportionate to servicing the population in the dense urban areas. Shows views of hilly gravel roads and graders at work maintaining them. Shows scenes of assessing planning applications in these rural areas which takes significantly more time as well as other services provided such as Meals on Wheels, building permits, Ranger services. Provision of recreational facilities in hilly areas requires the acquisition of expensive river flats (views of cricket ground surrounded by hills) and where not possible, costly earthmoving required. Also, views highlighting extensive tracks of natural habitat home to significant bird, animal and plant life. Shire emphasises its commitment highlighted by the Eltham Copper Butterfly which the Shire maintains small pockets of bushland to ensure its survival at significant expense (views of Pauline Toner Copper Butterfly Reserve.) Short interview with Pat Vaughan, Environmental Officer for the Shire discussing the Eltham Copper Butterfly who also mentions many other species in the Shire of high significance from bats to mammals to plants as well as the importance of the Green Wedge to Melbourne – the lungs of Melbourne - and ensuring the protection of very important habitat which requires a great deal of planning and management to look after. Views of Wingrove Park to emphasise this maintenance by machinery in some areas is too damaging and introduced species, etc must be removed by hand. Balancing the services and facilities expected by the community with the needs of the environment requires careful planning demands requires careful planning and the principals of the Green Wedge require constant attention in the face of growing need for housing. Director of Planning & Environment, Richard Allen advises there are approximately 1,300 planning permits and development applications each year ranging from simple subdivision, boundary realignments to further complicated non-urban developments for agricultural pursuits and the level of expertise required from architectural and engineering to land degradation, flora and fauna. It was prepared to help celebrate the 140th year of the school's existence on its original land grant of 1856, which appeared on the first surveyed land for the formation of the Town of Eltham, in the Parish of Nillumbik, County of Evelyn, granted by the then Government of New South Wales. It is inscribed in Harry Gilham's writing on page 1 - "For Eltham P.S Chronology 209 - 150th Anniv. book; Harry Gilham Collection; Unpublished" and stamped "Eltham District Historical Society" Pages 3 and 4 missing. Heather was the daughter of John Thomas Cone, Police Constable, and Charlotte Helena Cone (nee Black) who had married in 1906. Constable Cone was transferred to Eltham Police Station from Lauriston (near Kyneton) in May 1911. He retired from the force around September 1922 most likely as a result of significant health concerns experienced earlier that year from 22 April when he was hospitalised. He died 5 October 1922 at Maria Street at age 60 leaving behind a widow and two daughters; his son having pre-deceased him as a result of effects of the war. He is buried in Melbourne General Cemetery . In his probate it states that he owned a piece of land 200 links frontage to Maria Street and a depth of 241 links. It is believed that this is the land opposite the Police Station which Heather Jenkins referred to as being owned by her father and where he agisted the Police horses. Heather, her sister and mother Charlotte remained in Eltham until at least the 1924 Electoral Roll where Charlotte was listed as Home Duties however by 1925 she was listed at 229 Glenferrie Road, Malvern, occupation, Registrar of Births. In the 1934 (and 1936) Electoral Roll, Heather was a Clerk and her mother Charlotte was the Registrar of Births. in 1952 following her mother’s death she made application for Grant of Probate. Heather remains listed in the 1954 Electoral Roll at 13 Ashburton Road under her maiden name Cone however by the 1963 Electoral Roll she is listed at the same address as Heather McKnight Jenkins long with James Gardiner Jenkins. Neither appear listed in the 1958 Electoral Roll. James Gardiner Jenkins (1892-1975) first wife was Fanny Davison Carrucan (1899-1929), daughter of Denis Carrucan and Jane (nee McAleese). They married in 1925. Fanny died 11 November 1929. View looking north up Policeman’s Hill across Main Road towards the Police Station, Police Residence and Courthouse, c.1910 prior to Brougham Street being made. The two rails / gap in the fence would be where Brougham Street now enters Main Road. Also visible are Knapman's Forge adjacent to Courthouse and E.J. Andrew's Store on top of the hill At the upper left can be seen the front of the Evelyn Hotel. On the opposite corner was Watsons Hotel. E.J. Andrew's store with its verandah was on the corner of Franklin Street. Behind the picket fence stands the 1860 Court House and Police residence with the weatherboard clad Police office. The enclosed fence is now the end of Brougham Street, opened to Bible Street in 1926. The Evelyn Hotel (formerly Fountain of Friendship) burnt down in the 1930s when it was being used as a boarding house since 1919. A cow is feeding on the grass verge in street. The photo is identified in white lettering typical of the style of Clark Bros., photographers of Windsor, Melbourne (1894-1914). One of the brothers, John Henry Clark, took many early photos around Little Eltham and moved to Eltham in 1916 where he lived at the bottom of the hill. Typically, he would add “J.H. Clark Photo” to his personal work, but this is not evident. There is however some ghost writing, a cheeky inscription in small white lettering in the grass verge in front of where Brougham Street is, which appears to state: “Heather or Hannah was here”. Perhaps J.H. Clark took the photo during a trip to Eltham and gifted it some years later after moving there as a gift to a young Heather Cone. He was succeeded by George V.Heather Cone was the daughter of Constable John Thomas Cone (Badge 3935) the local police officer in residence at Eltham, 1 May 1911 to 9 July 1922. Heather McKnight Jenkins (nee Cone) was born 1911, possibly at the Eltham Police Residence and spent her childhood growing up in the Police Residence. Heather was the daughter of John Thomas Cone, Police Constable, and Charlotte Helena Cone (nee Black) who had married in 1906. Constable Cone was transferred to Eltham Police Station from Lauriston (near Kyneton) in May 1911. He retired from the force around September 1922 most likely as a result of significant health concerns experienced earlier that year from 22 April when he was hospitalised. He died 5 October 1922 at Maria Street at age 60 leaving behind a widow and two daughters; his son having pre-deceased him as a result of effects of the war. He is buried in Melbourne General Cemetery . In his probate it states that he owned a piece of land 200 links frontage to Maria Street and a depth of 241 links. It is believed that this is the land opposite the Police Station which Heather Jenkins referred to as being owned by her father and where he agisted the Police horses. Heather, her sister and mother Charlotte remained in Eltham until at least the 1924 Electoral Roll where Charlotte was listed as Home Duties however by 1925 she was listed at 229 Glenferrie Road, Malvern, occupation, Registrar of Births. In the 1934 (and 1936) Electoral Roll, Heather was a Clerk and her mother Charlotte was the Registrar of Births. in 1952 following her mother’s death she made application for Grant of Probate. Heather remains listed in the 1954 Electoral Roll at 13 Ashburton Road under her maiden name Cone however by the 1963 Electoral Roll she is listed at the same address as Heather McKnight Jenkins long with James Gardiner Jenkins. Neither appear listed in the 1958 Electoral Roll. James Gardiner Jenkins (1892-1975) first wife was Fanny Davison Carrucan (1899-1929), daughter of Denis Carrucan and Jane (nee McAleese). They married in 1925. Fanny died 11 November 1929. In the 1934 Electoral Roll he remained listed at John Street, Eltham, Railway Employee however by 1935 Electoral Roll, James Gardiner Jenkins, Railway Employee, was listed at 229 Glenferrie Road, Malvern and he remained living with Charlotte and Heather Cone when they moved to 13 Ashburton Road, Glen Iris. One of Constable Cone’s first investigations upon arriving in Eltham was the accidental fatal shooting in the head with a pea rifle by young Francis August Capewell, aged 11, of John Sutcliffe Deegan, 14, in Maria Street near the Railway. Constable Cone’s replacement was Constable William Charles Sargeant who commenced in charge of the Eltham Police Station from Thursday, 10 August 1922. Constable William Charles Sargeant, and his wife Elizabeth Agnes Sargeant were based at the Eltham Police Station until his transfer to the Police Station in Burwood Road, Hawthorn. He retired at Hawthorn Police Station in 1931, described by Hawthorn Council in 1927 as in a disgraceful condition and unfit for human habitation (Kathryn Griffin family tree – Ancestry) whereupon they moved to 28 Saunders Street, Coburg. Elizabeth died 16 July 1936 in Fitzroy. William then moved to 6 Queen Street Coburg in 1936 and then 1 Queen Street in 1942 where he died 7 August 1944. Victorian Institute of Occupational Safety and Health (VIOSH) Australia is the Asia-Pacific centre for teaching and research in occupational health and safety (OHS) and is known as one of Australia's leaders on the field. The Ballarat School of Mines Annual Report for 1921 states: 'It has been decided, for the present, to record the names of our students who served in the warm, in an Honor Book, and to defer the erectin of an Honor Board until we can feel ssured that the Roll is complete. the wide spread occupations of our students has rendered it very difficult for us to secure detailed information of their service. Angus McMillan named the Avon River after the river of the same name in his native Scotland. In 1840 he established a pastoral run at Bushy Park, north-west of the township. William Odell Raymond established a run in the area in 1842, and built his house, Strathfieldsaye, during 1848–54. European settlement did not take place without resistance, and in return, massacres were inflicted by Angus McMillan and others on Gunai people, especially between the years of 1840 and 1850. It was taken up by Angus McMillan, who also took up the 'Boisdale' run for his employer Lachlan Macalister at the same time. In March 1844 a Licence to occupy the 16,000 acre 'Bushy Park' was granted to McMillan. In the late 1840s Andrew Martin and Matt McCraw built Angus McMillan's Bushy Park homestead. Aboriginal killings in Gippsland area most often were never formally recorded, but lived on in folklore, mainly in place names pinpointing what some historians now refer to as "massacres", and others as "conflicts". Known as the Rosellas, the early Cheltenham Football Club sides began playing on a regular basis in 1890, and would travel long distances by steam train to play country teams, such as Ballarat where they would arrive at their destination, play the match, socialize then return to the station. Opposition players and supporters would give three hearty cheers on their departure. The Cheltenham home games were played on a paddock on the corner of Park and Charman roads in Cheltenham. In 1907 the Cheltenham progress committee made an application to the board of land works for land in Weatherall Road for recreational service to the public. That application was received and granted, then developed where Cheltenham Recreational Reserve now stands. The land in the early days was virgin bush and the response for voluntary help to clear the area was outstanding. Nearly all the market gardeners in the district along with horses, ploughs, axes, shovels completely cleared the area in three weeks. The Moorabbin council then leveled the playing area and erected a post and rail fence around the ground. Pine tree shrubs were then planted on the west side of the ground. The ground was opened in 1909 and the first Cheltenham side entered in the newly formed Federal Football Association along with seven other foundation members, Mordialloc, Mentone, Moorabbin, Frankston, Glenhuntly, Elsternwick, and Ellindale. The grand final for that year, 1909 was a hard encounter between Cheltenham and Ellindale with Cheltenham coming out victors, thus becoming the inaugural Federal Football Association premiers. Cheltenham went onto win five senior premierships in the Federal Football Association by the end of the 1920s, they won the flags in 1909, 1911, 1913, 1922 and 1925, with the late Percy Woff playing in all 5 premiership sides and was captain in 1922. 1928 saw the start of an outstanding career from our oldest living player Tom Connor. Cheltenham continued to win premierships in the 1920’s and 1930’s with juniors taking out the 1929 and 1933 flags, under the guidance of Woff, and that continued in 1934 when Cheltenham took out the 1st XVIII and 2nd XVIII premierships. Cheltenham produced its only Brownlow medallist in Peter Box who played in the late 1940s, before going to Footscray where he became a champion. The 3rd XVIII went through the season undefeated in 1974 winning the premiership, with Trevor Barker a key player before going to St Kilda the following year. The club won three senior premierships under coach Barry White in 1992, 1993 and 1995.
