Legal record - Transcript of High Court Appeal Philip Cooney v John Thomas Burns, 1921
The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Lancelot Herbert came to Orbost in 1886, taking up a partnership with local store-owner George Temple. After Mr Temple’s death in 1891, Lancelot took over the store and progressively developed Herberts Snowy River Stores which grew into a department store of several shops along Nicholson StThis is a pictorial record of transport in 19th century Orbost. Original owner Nora O’Connor the donor’s adopted aunt, migrated to Canada during WW2 and also worked as volunteer at the Vancouver Mission to Seamen where she met her husband Edward O’Connor who later migrated to Australia. NB Lightkeeper membership category across many of the Missions globally, was usually reserved for women busy as home-makers with children and also as a Junior membership category for children.The platter was accompanied by other materials from the Vancouver club of Senior Light keepers and together the material provides a parallel insight and reference to this group. It also provides a historical link within the worldwide network that is now recognised as the Mission to Seafarers. The Lightkeepers Auxiliary was also active with the Mission in Williamstown where they helped raised the funds to set up the new mission in the E,S & A Bank in 1943 which was furnished thanks to the High Commission of Canada.Circular , varnished wooden tray or plaque with beaded edge froming 'lip". Books, History of India, 1870s and 1880s
These books appear to have been published in successive years as the inscription on one is 1875 and the contents of another deals with the history of India in 1878. The owner of the volumes was William Cassady (1824-1885).In 1846 he settled near the Merri River in the district that is today the Cassady's Bridge area in Caramut Road, Warrnambool. The property was called "Boughton". He married Elizabeth Anderson in 1857 and they had eleven children surviving to adulthood.These volumes are of antiquarian interest as they are an attractive example of the type of books owned by early settlers in the Warrnambool district. The activities of the British in India would have been of interest to settlers in other parts of the British Empire at that time. The books are also of interest as they belonged to William Cassady, a prominent early settler in the west Warrnambool area.These are five volumes of hard cover books with green covers and elaborate scrolls and decorations on the front covers and spines. The title lettering on the front covers is in black and gold. Each volume has several pages of black and white illustrations (steel engravings)at the front of the books, all with protective tissue paper. Some of the tissue paper is torn or missing. There are several coloured maps. The pages are gilt- edged.The third volume has the top part of the spine and binding torn away. This photograph was taken in August, 1938 some eight years prior to the establishment of Mt. Beauty as a township. The area was still being used for grazing, and the land was eventually acquired from the local land owners by the State Electricity Commission. The construction of the road, from Tawonga to the High Plains, was commenced in April of this year. This allowed men and heavy equipment to be transported to the work sites for the construction of the Kiewa Hydro Electric Scheme This photograph is important as it shows the upper Kiewa Valley as it was before the establishment of the town of Mt. Beauty. The land has been cleared of natural growth and has been used for grazing cattle. By 1946 housing construction had commenced for the new town of Mt. Beauty and by 1948 street construction in the southern part of the town was completed as far as Hill Street.A black and white photograph of farmland with Mt. Emu in the background. This has been taken from where Mt. Beauty township now stands prior to road making and the erection of houses. A line of trees below the hill line indicates the position of the East Kiewa River. Petrol rationing was introduced in 1940 as Australia, which produced no oil of its own and had inadequate storage facilities, had only three months’ supply at the start of the War and depended on the procurement of stocks from overseas and their safe arrival. Rationing was introduced to ensure fair access by everyone to scarce goods. The Wurundjeri Woi Wurrung People were the original owners of the land on which the City of Boroondara is now located. They made active use of the Yarra for food and transport [an original canoe is held in the collection of the Melbourne Museum]. From 1863, members of the Wurundjeri Woi Wurrung were resettled at the Corranderrk Aboriginal reserve at Healesville. The [now] best known member of the Wurundjeri People was William Barak, who may be pictured here.If the attribution in the annotation is correct, then this may be the earliest photograph of members of the Wurundjeri People at Kew. Postcard - Williamstown Botanic Gardens, c1900-1910
The original postcards in this series (2013.002 to 2013.018) were generously loaned to Williamstown Botanic Gardens by a private collector for copying. The cast iron gates (manufactured in Glasgow) introduced at the North West entrance in 1907. The gates were purchased from ‘Fairlie” corner of Acland and Anderson Streets, South Yarra at the cost of 72 pounds and cost 60 pounds to install. They had originally cost the owners of ‘Fairlie’ 1200 pounds. The postcards are evidence of the interest the gardens held as a subject for postcard publishers. The text and images provide a snapshot into fashions, social interests and concerns of the time. The professionally produced images provide a pictorial history of Gardens including changing planting styles, various structures and features of the Gardens eg the aviary, cannons, the fountain, the second Curator’s Lodge and gates. The images offer an opportunity to compare garden vistas with the present day. The image in this postcard shows the gates intact and as installed in 1907. The current layout of this area still reflects the change of design, which followed the 1907 removal of the first gardener's residence and the subsequent re-organisation of this quarter of the gardens. This postcard is evidence of the placement of one of the cannons relocated from Fort Gellibrand in 1906. They were removed from the Gardens in the 1960s. These same cannons remain a feature on the Williamstown waterfront in 2013. Postcard in colour of main entrance gates, one of the cannons can be seen through the pedestrian gate on the right. The gates are cast iron, double carriage gates with single pedestrian gates on either side and supported by four cast iron posts with ornamental finials. Front: ‘Gates, Williamstown Gardens’. WW1 Victory Medal (faded) with MID leaf 3. Possibly Colonial Auxillary Forces decoration 1901-1938 (Green) or Colonial Auxillary Forces - Long Service 1901-1937 (Green). 4. Efficiency Decoration 1930- onwards (faded).. 1. Khaki jacket - old pattern. Four front pockets - held shut with dark copper buttons. Rising Sun Collar Badges. Lt. Details a Petition to the Parliament of Victoria, Legislative Council from the Melbourne Tramways Trust, the owners of the cable tram infrastructure. The Municipalities that formed the Trust were concerned that the construction of electric tramways within their Municipalities would be in contrary to the Act that set up the cable trams and reduced revenue received from the cable tram operator, the MTOCo. They sought that Parliament would not sanction such tramways without the consent of the Trust's municipalities or members. Yields information about the concerns of the MTT about new electric tramways in 1905.Folded double foolscap sheet and then folded into four for presentation to the Victorian Parliament by the Melbourne Tramways Trust dated 16-8-1905. This postcard is part of an album of postcards which date from late 19th century to mid 20th century. Bear's Castle is a unique and historical building constructed in the 1840s and classified by the National Trust for its design and construction techniques. The purpose of the 'castle' is contested but one theory is that it was built as a defensive citadel against attacks by bushrangers which had occurred prior to the owner, John Bear, ordering its construction.This postcard is in an album of postcards dating from the late 19th century to mid 20th century. It reflects the popularity of collecting postcards in Australia which reached a height in the early 1900s until around 1920. Various documents and correspondence detailing the history of the house and land on the corner of Dandenong and Waiora Roads, Caulfield, known as Cantala before being demolished and the land subdivided. The first document is a typed 3 page history from Caulfield Historical Society dated 02/1974, describing the owner of the property, Septimus Miller, as well as architectural features of the house Cantala. The second document is one page of typed correspondence from T J Hart to the editor of Southern Cross, dated 01/11/1973, describing the architectural features and history of Cantala. The file also includes a copy of a typed letter from Brighton Historical Society concerning research conducted about Cantala and the subdivision and detailing the owners and occupiers of flats erected where Cantala stood. Accompanying this document is a one page handwritten note providing the same details. Steam Locomotive - 1711 Peckett “Sir John Grice” Date built - 1926 Locomotive type ; Cranmore Original owner - Metropolitan Gas Coy., West Melbourne Original gauge - 762mm Withdrawn - 1941 Next owner - Whistle Stop Amusement Park, Frankston Built in 1926 for the West Melbourne site of the Metropolitan Gas Company, and issued to traffic the same year this saddle tank locomotive was named “Sir John Grice” in 1928. It was withdrawn from traffic in 1941 and stored until sold privately in 1962. In 1965 it was sold again and went to the Whistle Stop Amusement Park in Frankston and again stored until bought at auction by the Puffing Billy Preservation Society in 1974 and put on static display in the Steam Museum. Restoration started in 1978 and it was returned to service in 1981 painted light green with yellow lining. This photo was taken in c1910. ‘Warlingham’ has many typical Victorian features and has been restored and extended. The first owner was Thomas Kennedy Vernon Coburn, a solicitor. His wife was Sara Ethelwyn (Winnie) Cornell; they married on 26 March 1890. They had a large family and their eldest son (Arthur Wheeler Coburn) was born at 'Wannacul' Surrey Hills on 11 January 1891. The Coburns seem to have moved often and Thomas was declared insolvent in 1894, in part it would seem as a result of the land crash. The next owner was George Lumsden, grocer who is believed to have been there 1892-1896. He was married to Emma Louise Sim. During the years c1913-1919 Mr William Joseph Trenerry (manufacturer) and his wife Elsie (nee Capon) lived here. In the 1919 electoral roll the house name is given as 'Mosman', which may be a reference to Elsie Trenerry's origins; she came from Sydney. See also SHP1927 and SHP1384. These handmade baby clothes are a fine example of home crafts, showing attention to detail. The original owner and maker of these handmade silk baby clothes is unknown. They were previously owned by the mother of the donor. Her name was Mary Patricia (Pat) Mulready 21.4.1934 – 4.2.2007 who was born, died and died Warrnambool. The clothes were possibly purchased from an opportunity shop as clothing for her daughter Eileen Mulready, 3.10.1968 - Jan 1991.Baby clothes, hand crocheted fine, fawn coloured silk thread. This book has the stamp of ‘Ecker’s Hotel’. This hotel was on the east side of Liebig Street between Lava and Koroit Streets and was opened in 1875 by James Dooley. It was take over in 1885 by James Taylor and then by Joe Ecker in 1910. When Joe Ecker left the hotel in 1923 the licensees following retained the name ‘Ecker’s’. The hotel closed in 1962. It is the only hotel in Warrnambool to have had no other name except that of three of its owners. This book is only of interest because of its connection with Ecker’s Hotel, well-known in Warrnambool for 90 years as a comfortable, well-managed place to stay or visit. No doubt many of the clientele were farmers and this would explain the reason for the book being retained at the hotel. This is a hard cover book of 408 pages. It has a green cover with black lettering on the front cover and on the spine. It has a Preface, a Contents page, 25 chapters of Text, a Gestation Table and an Index. There are many black and white photographs and illustrations scattered throughout the text. The back page is torn and the cover is scuffed and the book is a little warped out of shape. Alfred Darby leased a cordial factory in Henna Street, Warrnambool in 1897. The Maltese cross was his well known trade mark. In 1899 he tried to start another cordial factory in Koroit Street but was prevented from doing so because it contravened the agreement he had with the owner of the Henna Street building. It is not known when he left Warrnambool but he had an interest in another cordial factory in Rochester, Victoria. This label is of considerable significance as details of Alfred Darby's cordial manufacturing business operations in Warrnambool are scant.Primarily a rectangular shaped label with all the edges curved. It features text , scrolls, a Maltese cross, lemons, flowers, leaves, berries, grapes and another puce coloured fruit.It is multi coloured. It is adhered to a piece of white card. These documents come from a collection of material from the Baulch families of Dunmore and Rose Park estates in Western Victoria in the Macarthur district. They concern the sales of the Green Hills Estate (1910) and the Olangolah estate (1915) near Woolsthorpe. Both were offered for sale by the owner, Colin Tulloh. The properties bordered on Baulch property belonging to Stan Baulch (1897-1980) and hence this is the reason for their being included in Baulch estate material. These items are of minor interest and will be useful to researchers as they show the sizes and some owners of some early 20th century Western District properties. .1 A single sheet of white paper with a map or plan of a property and black printing.
