Tait collection: item 48 of 62 This is a document giving details of the Will and Probate of William James Osborne, a Tallangatta farmer who died in 1896 at the age of 59. His death place is given as Tower Hill. A William Osborne is listed as a Wangoom farmer in 1856, a farmer at ‘Thompson’s Old Farm’ in Allansford in 1866 and a farmer at Winton Farm on the Allansford Road near Shipley in 1869 but these references may be to William Osborne’s father as there is mention of a William Osborne, Junior at that time. William James Osborne left real estate to the value of £560 and personal estate to the value of £81 to his wife, Hannah. The lawyer who drew up this document was Ernest Chambers who had legal offices in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. He was in possession of this document and it has passed down to successive lawyers occupying the legal premises in Kepler Street where it was located in 2014 (former premises of the law firm of Mackay Taylor). This document is of interest as it gives details of the Will and Probate of William James Osborne, a farmer in the Allansford area in the 19th century. This is a cream-coloured piece of parchment paper folded in two to make four pages. Three of the pages have handwritten material in brown ink and the pages are not ruled. A seal of the Supreme Court of Victoria is attached with a green ribbon and there is one red stamp of the Master in Equity of the Supreme Court. The document is somewhat stained but legible. This spinning wheel was recovered in pieces from N.S.W. and re-assembled in the 1980s by Les O'Callaghan, a Warrnambool historian and President of the Warrnambool and District Historical Society for many years. The spinning wheel is believed to have belonged to Alice Allan (nee Mullaly) who married William Osborne Allan in 1844. They had three sons. William Allan was a pioneer settler who, in 1839/40, established, with his brothers, a property (Allandale) east of the Hopkins River in the area known today as Allansford. During the 1840s the property was divided with William taking up the Allandale section and his brother John taking the Tooram section. William died in 1860 and Alice continued to manage the property with the assistance of her sons until her death in 1887 when the Allandale estate was sub-divided. A spinning wheel such as this would have been an important item in a pioneer settler's home with the wife needing to spin wool or sometimes flax to produce cloth for clothing and furnishings. This spinning wheel is of considerable significance as it is believed to have belonged to Alice Allan, a pioneer settler in the Warrnambool district. This cookery book was produced in 2014 as a school fundraiser. It was purchased at Allansford Cheese World in January 2015 for $15. Allansford school was established as a National School in 1856 on land reserved for the purpose by John McMahon Allan. It comprised two sandstone classrooms -one for boys and one for girls -with an attached pise teacher's residence. In 1872 when the Victorian Education Department was set up existing schools were listed in alphabetical order and given a number. Allansford State School was No.3. The school was enlarged in the late 1800s and again in the early 1920s. In 1994 following the amalgamation of the Allansford, Allans Forest and Naringal schools a new school was built which adjoined the existing buildings. The old buildings were refurbished as administration and staff facilities. John McMahon Allan settled in the area in 1839 with his brother William Osborne Allan. They were the sons of David Allan, Deputy Commissary General during Macquarie's term of government. The brothers divided the station with William retaining the Allandale portion and John naming his portion Tooram. John McMahon Allan was president of the early district Roads Board. In an attempt to recoup some of the heavy losses due to the disastrous Bateman fire of 1854 John subdivided a portion of Tooram at the Hopkins River crossing known as Allans ford. The Eltham Shire War Memorial, a tower of remembrance, was built with public donations to commemorate the memory of the fallen soldiers from the shire who enlisted in the 1914-1918 war. The tower is reminiscent of the peel-towers or watchtowers that lined the English-Scottish border from the mid 14th century to around 1600 and is constructed from locally quarried stone. This uncommon and picturesque war memorial, which affords an excellent view of the surrounding district was unveiled by His Excellency the Governor-General (Lord Stonehaven) on November 11, 1926. In July 1922 a deputation of returned soldiers from Panton Hill, presumably the Panton Hill branch of the Returned Sailors and Soldiers Imperial League of Australia (RSSILA), proposed to Eltham Shire Council that the monument should be a cairn of local stone “sufficiently high to form a prominent and conspicuous landmark, and crowned with some suitable device”. Eltham Shire Councillor and President of the Panton Hill branch of the RSSILA, Basil Hall, was credited with being the first to suggest a tower, and with organising a Memorial Park committee to raise funds for the monument in the Memorial Park. A meeting for those interested in the establishing a War Memorial monument in the park was held in January 1924 and the Eltham Shire War Memorial League was formed for this purpose. It appears that the broad and rounded cairn that had been recently built was considered by the League a temporary affair, and not the substantial cairn-as-monument, sufficiently high to form the conspicuous landmark, which had been envisaged by the Panton Hill RSSILA. A design competition was held for the monument. The chairman of the League, Councillor Basil Hall, suggested that the site of the memorial in Kangaroo Ground would lend itself to something rugged, instead of polished stone. By April 1924 thirty designs for a memorial had been received from which three designs were selected and of those, the design by the shire engineer Mr McCormack, for a 70ft tower suitable for construction in rough stone, was chosen. Artist Harold Herbert suggested that a peel tower-like design reminiscent of those along the English-Scottish border would be fitting for the site. Herbert drew up a rough sketch that was approved of, and later, Melbourne architect Percy Meldrum volunteered to draw up the design from sketch to architectural drawings. By January 1925 the Soldiers’ Memorial League had adopted Meldrum’s design for a 50ft high tower. Meldrum had also offered his design and supervision of construction free of charge. The Shire provided the stone to the builders, which was a gift quarried from land owned at Kangaroo Ground by Dr Ethel and Professor William Osborne The Shire of Eltham War Memorial, a tower of remembrance, and honour board were unveiled on November 11, 1926, by the Governor General Lord Stonehaven. At this stage a temporary honour roll was painted on the panels on either side of the tower entrance. In September 1930 bronze plates were added above the portal with the names of men who fell in the 1914-18 war. On November 16, 1951, the Governor of Victoria, Sir Dallas Brooks re-dedicated the war memorial tower and unveiled the names of men who gave their lives in the 1939-45 war. Two additional bronze plaques which recognise service in the armed conflicts of Korea, Borneo, Malaya, and Vietnam were unveiled November 11, 2001, by the Governor of Victoria, John Landy, A.C., M.B.E. The tower was first used for fire spotting activities following the Black Friday bushfire in January 1939 in response to a request from Mr R.D. Ness, secretary of the Kangaroo Ground bush fire brigade, who asked Council that the tower be used as an observation tower for detecting bush fires, and asked Council to arrange a telephone to be installed. It was suggested that if the Shire were to appoint a caretaker for the Memorial Park, his duties could also include raising the alarm in the event of a fire. Later in 1939 Council applied for a radio transmitter, which the Forestry Commission planned to install at vantage places throughout the state. The first dedicated fire spotter appointed from December1948, was Mr Smith of Warrandyte. A prefabricated glazed cabin was installed in 1974, which involved the removal of the original stone structure around the rooftop exit door. A new fire spotting cabin, which included the latest technology, was installed soon after the 2009 Black Saturday fires and is manned by CFA personnel on high fire danger days. Eltham and Whittlesea Shire Advertiser and Diamond Creek Valley Advocate Fri 21 May 1920 p 2 reported: Kangaroo Ground Memorial Park "It was decided to arrange for a working bee on Saturday, 29th inst., for the purpose of forming and gravelling the track leading to the Park, and of carrying out other necessary works." A history summary of the Shire of Eltham Soldiers’ Memorial Park • The summit at Garden Hill was a popular tourist lookout and picnic spot from the 1880s. Virtually the entire Shire of Eltham and beyond could be viewed from this location. • A local farmer, Mr Walter A. D. Wippell is credited as being the first to propose the idea of a war memorial park and offered £50 towards the purchase of the land. • The earliest public reference to this project is to be found in the local Advertiser newspaper edition of August 9th, 1918. A report of the August Council meeting records the Eltham Shire President, Cr. Robert White, saying: "some time back it was proposed that the Council obtain and place on an Honour Board in the Council Chamber [at Kangaroo Ground] containing names of the lads who had enlisted. Just recently however, it had been suggested that a more fitting memorial would be the obtaining of a piece of land on the summit of Garden Hill, Kangaroo Ground, and the formation of a memorial park in which a monument could be erected to represent the whole of Shire. If a couple of acres could be obtained a gentleman had promised to donate 50 pounds, and another one would fence it, and other contributions, he was sure, could be obtained." • Councillors were favourable of the proposal and the President, Shire Secretary and Shire Engineer were deputised to wait on Messrs Mess Bros. (the owners of the Garden Hill farm) and ascertain if they would gratuitously give the land. The Mess Bros. land adjoined the farm/stud of Mrs Fanny White (Cr Robert White’s mother), daughter of Andrew Harkness who established their property on Garden Hill around 1846. • Access to the land came in February 1919 when several Councillors and the Shire Engineer surveyed the actual two acres of '5 chains along the road and 4 chains deep'. The Engineer volunteered his services free to do this task. The Mess brothers however demanded £100 per acre but eventually agreed to take £50 per acre. • Entry from the Kangaroo Ground-Yarra Glen road was seen to be a problem and Mrs. White, who owned the land beside the park, was asked to donated a triangle of her property to allow this access. • By September 1919 returned soldiers were employed by the Shire and volunteers were called to clear the hilltop by ploughing up the rocks and clearing the area, the fencing was put into place and in May 1921 the Council erected three gates, within an archway, at the entrance to the drive and pathway to the summit. • Public subscriptions were sought through the Advertiser newspaper to beautify the site. The views of the Curator of the Melbourne Botanical Gardens were sought as to the ‘class of ornamental trees most suitable for planting in the Park area”. • The Memorial Park or Shire of Eltham Soldiers’ Memorial Park was officially opened by Mr. W.H. Everard, M.L.A., 3 September 1921. • In 1922 plans were made to place a War Memorial in the Park. Funds were donated by the Council of £250 and a challenge to the community, to match this money with contributions was met. • On Anzac Day 1923, 1,000 people gathered on the summit in the park for a memorial service. A much smaller group of about 50 people gathered around a newly constructed cairn and flagstaff in the afternoon of Anzac Day 1924 amidst rain and a squally southerly wind, the morning service being cancelled. • A meeting for those interested in establishing a War Memorial monument within the park was held in January 1924 and the Eltham Shire War Memorial League was formed and a design competition decided upon. • The Shire of Eltham War Memorial tower was built in 1926 at a cost of £1,023 and 5 shillings with locally quarried stone donated by Dr Ethel and Professor William Osborne. It was formally known as the ‘Shire of Eltham War Memorial’ and was unveiled on 11 November 1926. The large bronze inscription above the entrance to the tower states: SHIRE OF ELTHAM WAR MEMORIAL THESE MEN DIED FOR THEIR COUNTRY 1914 IN REMEMBRANCE THIS TOWER WAS BUILT 1918 • The Caretaker’s hut was built in 1927 with left over from the tower construction. • A returned soldier was appointed to act as caretaker for the memorials. Tiny Carrol, a huge man, was the first caretaker and lived in the stone hut. There was a push to have alterations made at one stage to provide additional rooms for a married caretaker but was rejected. • A new Caretaker Cottage was built in 1951 at a cost £2,500. The cottage had been subjected to raids by thieves three times during construction until a guard from the Returned Servicemen’s League was posted until its opening. • The War Memorial tower was re-dedicated by Sir Dallas Brooks on 8 November 1951, unveiling new bronze plaques containing the names of those who fell during the Second World War. Sir Dallas also officiated the opening of the new Caretaker’s Cottage. • A toilet block was built in 1965. • A further dedication of the Shire of Eltham War Memorial tower took place 11 November 2001 to recognise the men who fell in subsequent campaigns up to and including Vietnam. • Four land titles are involved: o The purchase of the two acres from owners Ruth Gosling, Alexander Mess, James Johnson Mess and Joseph Mess is recorded in two actions, the first being the payment of £100 for the two acres, the second showing that the Shire of Eltham did not get a transfer of title until 14th January 1952. o The access land donated by Mrs. Fanny White is dated 26 February 1924. A further need to widen the entry came after the deepening of the road cutting and another land donation was given by Sir Herbert Gepp, title dated 15th May 1952. This would have been about the time he sold off the former White ‘Garden Hill’ property. o The land reserve to increase the area and possibly allow a circuit road to be put in place on the western side of the park was purchased by the Shire of Eltham, title dated 16th February 1973. Grassmere is a small hamlet about 12 kilometres from Warrnambool. It is a farming area. The Grassmere Gold Mining Company, presumably established by local people in Grassmere, was created in 1898 for the purpose of acquiring from Messrs James and Mewha a lease of a Cassilis gold mine (23 acres). £5000 was to be raised in shares of five shillings and one shilling each. The Manager of the Company was Horatio Dickson of Melbourne and the brokers were McMeekin and Co. of Melbourne and Warrnambool and Dickson and Osborne of Melbourne. This reef mine was one of several in Cassilis, Gippsland, 12 kilometres north west of Swifts Creek. The gold-bearing quartz reefs were discovered in 1885 and worked to 1914. It is not known whether the Grassmere Cassilis mine was a financial success but the mining operations were impeded by the hardness of the stone in the area. William Robinson was a farmer in the Grasmere district. This receipt is of considerable interest as one of only three items the Warrnambool and District Historical Society has that is connected to the Grassmere Gold Mining Company. The gold mine establishment was one of the minor events in the district in the 1890s. This is a buff-coloured 1899 receipt for William Robinson who has paid six shillings and threepence for part payment of his shares in the Grassmere Gold Mining Company. The receipt has black printing and black-ink handwriting. There is one stamp of the Manager ‘H.S. Dickson’ and another of ‘Grassmere Gold Mining Company No Liability’. The receipt has several holes caused by silver fish damage. ‘March 11th 1899, Received from Mr Wm. This was the first police station built in Watgania, and it was probably built during the goldrush era of late19C to early 20C.The photo is of local significance to Watgania and the Ararat district because of its rarity and because of its subject. There is now (in the year 2023) little or nothing left of the township of Watgania, north of Willaura, though there are still several inhabited properties in this area, which shelters close under the eastern face of the Grampians mountains. The figures in the photo add to its significance, since a good deal of information about the goldfields can be gleaned from their manner and their dress.Black and white photograph mounted on cardboard. This hand written letter, in black ink script on blue lined paper, is impressed with the official stamp of the Victoria Steam Navigation Board. The left margin has the reference “S82/12" It is transcribed: "Victoria Steam Navigation Board, Melbourne, January 12th 1882 To Frederick Chapman, Master, S.S. "Julia Percy" You are herewith furnished with a copy of the report of the Official Court which assembled to enquire into the circumstances attending the collision between the steamers "Julia Percy" and "Nelson" off Apollo Bay near Cape Otway on the morning of the 25th December 1881, and you are hereby expected to attend at the Board Room, Custom House, Melbourne, at 2pm, on 13th January instant to show cause why you should not be censured accordingly. [Signature] Secretary" This document refers to the matter of a collision between two steamships, the Julia Percy and the Nelson, on 25th December 1881. The Julia Percy was at that time owned by her first owners, the Warrnambool Steam Packet Company, and she sailed under the command of Captain Chapman. She had left Melbourne the evening of 24th December, with about 150 passengers, sailing in fine weather through Port Phillip Heads around 9pm. She was headed for Warrnambool, Belfast (now named Port Fairy) and Portland. The Julia Percy was off Apollo Bay when Captain Chapman was woken by the ship’s whistle after midnight, the steamer Nelson being on a collision course with the Julia Percy.[See Link.] The Nelson struck Julia Percy midship. Boats were lowered from the ship (apart from a damaged lifeboat) and about 30-40 of the passengers boarded the Nelson. The engine room and the forehold were checked and found clear of water. The company manager, Mr Evans, had been on the Nelson, so he boarded and inspected the Julia Percy and the decision was made to continue on to Warrnambool with the passengers as there appeared to be no immediate danger. However, Captain Thomas Smith said the Nelson was taking on water, so Julia Percy followed her for about an hour towards Melbourne on standby in case of need. Then Julia Percy turned around towards Warrnambool again. Shortly afterwards the Nelson turned to follow her, the ships stopped and passengers were returned to Julia Percy, and three from Julia Percy boarded the Nelson. Both ships proceeded on their way. Julia Percy passed Cape Otway light afterwards, signalling that there had been a collision. It was discovered later that one of the passengers was missing, then thought to have boarded the Nelson but later thought to have fallen into the sea and drowned while trying to jump from Julia Percy to Nelson. There had been 3 tickets purchased under the same name of that passenger “Cutler”; a father, son and friend named Wordsworth, which had caused quite some confusion. No further mishap occurred to either ship and both the Julia Percy and the Nelson reached their destinations safely. An enquiry was instigated by the Victoria Steam Navigation Board regarding the cause of the accident between the two steamships, in connection with the death of Cutler who was supposed to have lost his life by the collision. The enquiry resulted in the following decision: "The Victorian Steam Navigation Board having taken into consideration the points urged by Captain Thos [Thomas] Smith and also by his legal advisers, is of opinion that the charge prepared against him has been sustained, but taking into consideration Captain Smith’s previous good conduct and character, the board suspends his master’s certificate No 227 issued by this board for a period of six calendar months from this date – Robert Fullarton, Chairman. “The Victorian Steam Navigation Board having beard the statement of Captain Frederick Chapman urged in his defense to the charge of dereliction of duty as master of the Julia Percy, in having no standing order on board that vessel to be called in the event of any approaching steamer’s lights being seen, find such charge sustained, and censure him accordingly – Robert Fullarton, Chairman.” ABOUT “JULIA PERCY” The S.S. Julia Percy (later named Leeuwin ) was an iron passenger-cargo steam ship built in 1876. At one point in time the Julia Percy would sail from Warrnambool to Melbourne every Friday and return from Melbourne to Warrnambool every Tuesday. The cost of a return ticket for a Saloon Fare was £1.0.0. She would sail “if practical and weather permitting”. Shipping was the cheapest and most practical means of carrying produce and goods during the period 1840-1890. Regular domestic steamer services commenced in the Warrnambool district in the late 1850’s and by 1870 the passenger trade was booming. Produce was loaded from the jetty into ‘lighters’ (small boats), which took it to the ships at anchorage in the bay. Passengers were taken to the ship’s side then climbed aboard up ladders or gangways. The coming of the railway in October 1889 meant the gradual decline and end of the steam shipping era. The Julia Percy was built in Glasgow by Thomas Wingate & Company, Whiteinch, in 1876 for the Warrnambool Steam Packet Company, which commissioned her for trade in Victoria’s western district. She was first registered in Warrnambool, Victoria in 1876. The Julia Percy changed hands several times. Her next owner was the Western Steam Navigation Co (1887), managed by Mr. T.H. Osborne (the company’s office was on the corner of Timor and Liebig Streets, Its north-western wall is now part of the current Warrnambool Regional Art Gallery. ) The Melbourne Steamship Co became the next owners (1890), followed by William Howard Smith and Sons (1901) for use in Queensland coastal trades, then she was bought by George Turnbull in 1903 and used for local mail contract in Western Australia. The Julia Percy was sold to the Melbourne Steamship Company Ltd. (1906) and re-named the “Leeuwin” but continued in her Western Australian coastal run. She was converted into a coal hulk in Melbourne in 1910 as a result of damaged caused when she was driven against the jetty at Dongara during a gale. The ship was eventually dismantled and scuttled in Bass Strait on 28 December 1934. The document is significant for its association with the wreck of the Leeuwin (Julia Percy), which is on the Victorian Heritage Register, VHR S413. . It is historically significant for being a rare artefact that has potential to interpret aspects of Western Victoria’s 19th century steamship trade and Victorian cultural history. The Leeuwin (Julia Percy) is listed on the Victorian Heritage Register as being historically significant ‘as one of only four wrecks of steamships in Victorian waters associated with the western district of Victoria’s coastal steamship trade. The sample of steel from which the S.S. Julia Percy’s boiler was made has been tested, according to the attached label. The test involved heating the steel to blood red temperature (or dark red colour) then dipping it into water and bending it when it was cold. A “very severe test for quality” was written on the ticket by T.H. Osborne. (Mr Thomas Hamilton Osborne was the secretary for the Western Steam Navigation Co, established in Warrnambool in 1886. The company’s office was on the corner of Timor and Liebig Streets in Warrnambool and its north-western wall is now part of the current Warrnambool Regional Art Gallery. ) Cold bending of steel in a press or through rollers is the typical method of curving steel for construction. The steel needs to be manufactured in such a way that it is strong enough yet still flexible enough not to crack when bent or rolled. The boiler on the Julia Percy could have been a Scotch Boiler, a design introduced in the 1870’s and still being used today. This design was more robust that previous boilers, generating higher working steam pressures. The design incorporate greater ability to roll iron plates, leading to greater strength, thicker plating and fewer riveted joints. They were originally made of iron then later incorporated steel sections until they were entirely constructed of steel. Many examples of this type of boiler can be found on wreck sites. Melbourne Steamship Co became the next owners (1890), followed by William Howard Smith and Sons (1901) for use in Queensland coastal trades, then she was bought by George Turnbull in 1903 and used for local mail contract in Western Australia. She was sold to the Melbourne Steamship Company Ltd. (1906) and re-named the Leeuwi but continued in her Western Australian coastal run. She was converted into a coal hulk in Melbourne in 1910 as a result of damaged caused when she was driven against the jetty at Dongara during a gale. The ship was eventually dismantled and scuttled in Bass Strait on 28 December 1934. The steel sample is significant for its association with the wreck of the Leeuwin (Julia Percy), which is on the Victorian Heritage Register. It is historically significant for being a rare artefact that has potential to interpret aspects of western Victoria’s 19th century steamship trade and Victorian cultural history, including the testing and manufacturing process associated with steam power. Leeuwin is listed on the Victorian heritage Register as being historically significant ‘as one of only four wrecks of steamships in Victorian waters associated with the western district of Victoria’s coastal steamship trade. Her registered number is VHR S413. A sample of the steel from which the boiler of the "SS Julia Percy" (later named Leeuwin) was made. The piece of steel is a ‘C’ shape with the ends almost meeting. A luggage ticket is tied onto the steel and has an inscription on it. The steel is rusty.Ticket with typed information “Steel of which the Boiler of the “Julia Percy” (Warrnambool Steam Navigation Co) was made. TEST: Made Blood hot or Dark Red then dipped into water and bent cold. A very severe test for quality T.H. Osborne.
