This letter book contains the correspondence from the legal firm of William Ardlie in Warrnambool to other legal firms in Melbourne and other parts of Victoria (1951-1957). The correspondence deals mainly with legal matters concerning property transfers, wills, probates and court cases. William Ardlie (1943-1933) was the son of John and Mary Ardlie, pioneer settlers in Warrnambool. In 1865 William Ardlie established his legal practice in Warrnambool, initially in partnership with George Barber. William Ardlie, prominent in community affairs in Warrnambool, practised as a lawyer until the early 1930s and the firm continued on after his death with members of the Ardlie family involved in legal firms in the Warrnambool district until the early 21st century. This letter book is of historical interest because of the letters dealing with the property, wills etc of many residents of Warrnambool and district during the 1950s. It will be a useful research tool. This letter book of 393 pages has a buff-coloured cover which is somewhat stained. 227 pages contain copies of letters written over a period of seven years and the rest of the pages are blank. The pages are of a lightweight strength. These items, 1930s bank books belonging to Michael Toohey, a Woodford farmer, come from the estates of the Ardlie family of Warrnambool and appear to have been stored amongst the office material of the prominent Warrnambool lawyer, William Ardlie (1843-1933). He was the son of pioneer Warrnambool settlers, John and Mary Ardlie. William Ardlie established a legal practice in Warrnambool in 1867, initially in partnership with George Barber. Ardlie was a dominant figure in legal and community circles in Warrnambool and continued with his legal practice until the early 1930s. The bank books were issued by the Commercial Banking Company of Sydney. A Warrnambool branch of this bank was established in 1927 when it acquired the Bank of Victoria. The Warrnambool branch of the Bank of Victoria at 92 Liebig Street then became the Commercial Bank of Sydney. In 1958 the bank building was demolished and new premises were built. Tait collection: item 33 of 62 This probate document gives details of the will of Thomas Smith, a farmer in the Wangoom district who was a pioneer settler, having arrived in the area about 1848. He erected the Shamrock Hotel in Dennington in 1868 and it was opened for business in 1869 with David Duffy as the first licensee. Thomas Smith was the licensee in 1870 and members of his family (Cornelius, Robert and Mary Smith) held the licence of the hotel until 1880. A codicil to the will gave Mary Smith, Thomas’ daughter, the hotel land and building. This hotel closed in 2011. Thomas Smith signed the original will with a cross (his mark). These certificates of death are original and give details of 47 deaths from July 1853 to February 1855 with the deaths mostly from the Villiers district in the Parish or Township of Warrnambool. The deaths have been registered by John Martin Ardlie and the doctors’ signatures include those of Isaac Corney and Berkeley Hutchinson. This booklet is of high significance as many of the deaths recorded herein are not registered anywhere else and some were buried in the Warrnambool Cemetery before official records began. The Warrnambool Cemetery was gazetted in June 1854. The certificates were found in a private house in Warrnambool.This is a bound booklet with a black linen cover and containing 40 pages. The pages are designed to have the information written twice with one section called the Counterpart and the second called the Original Certificate of Death (Schedule B). The counterpart section was meant to be kept in the booklet and the second section was to be cut out and sent or put elsewhere. The first seven pages have the one Counterpart section and the rest are complete with the two sections. The pages are blue with printed headings for the Registrar of Deaths to fill in. The information on 12 of the pages are incomplete and the entries are handwritten in ink. This plate came from St Ann’s School, Warrnambool. It was probably used in the boarding house section and may have been used for either soup or cereal. St Ann’s School opened in 1872 as St Mary’s Convent of Mercy School, Wyton, with the latter name being the name of the ex-John Ardlie house in which the school was initially established. There were eight foundation Sisters of Mercy. The name changed to St Ann’s Convent School in 1888 and in 1991 it amalgamated with the Warrnambool Christian Brothers College to form Emmanuel College.This plate is an interesting memento of St. Ann’s School in Warrnambool in the mid 20th century.This is a round china plate with a green and yellow band around the inner edge of the plate. There is also the emblem of the school with the name and motto. The plate has a dip or recess in the middle. This glass has been issued to mark the end of the name of St. Ann’s College, Warrnambool in 1990 and the school’s amalgamation with the Warrnambool Christian Brothers College in 1991. This letter book was used by George Barber to produce letters to send to clients and to retain a copy of this correspondence. Barber was a prominent Warrnambool lawyer in the 19th century. English-born George Barber (1814-1897) came to Warrnambool from Port Fairy in 1853, making him one of the earliest lawyers in the town. In 1867 he formed a partnership with William Ardlie, and this partnership continued until Barber retired in1879. Barber was active in community affairs, being involved with such institutions as the Warrnambool Cricket Club, the Warrnambool Hospital, the Warrnambool Gas Company and the local Horticultural Society. This letter has a connection to one of Warrnambool's important early lawyers and will be useful to researchers if the handwriting can be read.This is a letter book of 750 pages with a hard grey-coloured cover and black taping on the spine. The front cover has a paper label with a handwritten title on the outside and a signature on the inside cover The cover is partly detached from the spine. The pages contain an alphabetical index at the front and copies of handwritten letters. There are many pages unused and there are three loose paper items seemingly not connected to the contents of the letter book. The Warrnambool Standard newspaper was started in 1872 by William Fairfax and Henry Laurie. It continues in that context today as a daily newspaper for the Western District. This copy is dated July 1 1905 and covers items of interest and advertisements for current businesses many which continued as household names until the latter part of the 20th Century. These include the following: J Younger, E Battarbee, Beattie and Phillips,Wm Ardlie, H G Wilkinson Cramond & Dickson, F Tozer, Wm Swinton, Bruce & McClure. There are reports covering items of local, national and International news events.This paper provides a snapshot of history in the given era from a Warrnambool perspective. These are the Probate papers for Patrick Mahony, a farmer from Wangoom who died in 1894. He left an estate of £995 and personal effects worth £138. The estate was to be administered by the two sons, William and Timothy in trust for another son, Michael Mahony. The wife Margaret was granted three acres of land, £25 a year and ‘the choice of two cows out of my stock’. The daughter Johanna was to receive the same benefits after the death of her mother. Patrick Mahony, being illiterate, signed his will with a cross. The latter had a practice in Warrnambool for the best part of seventy years, firstly in Timor Street and then in Kepler Street. He was a prominent resident in Warrnambool. The document was originally in the hands of the law clerk, Thomas Goodall and it was passed on to lawyers occupying the Kepler Street premises until it was found in the buildings once used by the law firm of Mackay Taylor. This is a piece of parchment paper, folded in two with writing in black ink on all four pages. Tait collection: item 43 of 62 This is a document giving details of the Letters of Administration of John Moloney, a farmer from Bushfield, who died in July 1897. He died intestate but had real estate to the value of £510 and personal estate to the value of £142. The beneficiary was his wife, Mary Ann Moloney. The lawyer involved in drawing up this document was William Ardlie, one of the best-known lawyers in Warrnambool in the 19th and 20th centuries. He commenced his business in the 1860s and continued on until the 1930s when he was well in his eighties, making him at the time the oldest practising lawyer in Australasia. The document seemed to have been passed down by successive lawyers occupying the Kepler Street legal premises and located there in 2014.This document is of some interest as it gives details of the Letters of Administration of John Moloney, a 19th century farmer from Bushfield and it also concerns the lawyer, William Ardlie, a prominent Warrnambool lawyer at that time. St Ann's college history dates back to 1872 with the arrival in Warrnambool of eight Sisters Of Mercy from Ireland. They purchased Wyton House, which was the former home of Mr William Ardlie, soon after their arrival, and the first school was opened that same year. It was initially known as St Mary's and had both day and boarding scholars. When the chapel was built in 1888, the name was changed to St Ann's. It operated as both primary and secondary education until 1974 and in 1991 it amalgamated with nearby St Joseph's CBC and became co-educational operating as Emmanuel College. At that time the uniform changed from the familiar green with yellow to navy blue and maroon. The motto translate as Work conquers all. This blazer belonged to one of the last students to attend both St Ann's College and Emmanuel College and was Vice Captain of Emmanuel College in Year 12. Tait collection: item 59 of 62. This document gives details of the Will and Probate of Frederick Gazzard of Allansford who died in September 1901. Frederick Gazzard owned the ‘Tooram’ bacon and ham curing factory at the corner of Carrolls Road and Tooram Road in the Allansford area and employed six men. He was a founding member of the Allansford Church of England and lived with his family of seven children at ‘Como’, Allansford. He left real estate to the value of £1,440 and personal estate to the value of £1,664. The beneficiaries were his children, with his household effects and £200 going to his daughter, Ellen. She is believed to have taken an active role in the administration of the family factory. This document was drawn up in the office of William Ardlie, a prominent lawyer in Warrnambool for over sixty years. It has then been passed down to successive lawyers occupying legal premises in Kepler Street until it was located in these premises in 2014. This document is of considerable interest as it gives details of the Will and Probate of Frederick Gazzard. He and his family were prominent and influential in the community life of Allansford in the 19th century. This is a cream-coloured piece of parchment paper folded in two with blue lines ruled at the edges of three of the pages. There is handwritten material (brownish-black ink) on three of the pages. A seal of the Supreme Court of Victoria is attached with green ribbon and there are six red stamps of the Master in Equity of the Supreme Court and one blue stamp of the Warrnambool Savings Bank. St. Anns College had its beginnings in the arrival in May 1872 of a group of nuns from Ireland. They were the third group of Sisters of Mercy to come to Victoria. The Warrnambool nuns worked hard to establish a school and orphanage for the socially disadvantaged children of the district. They purchased Wyton from Captain Ardlie that year and also Amhurst later on. The Nazareth sisters of Ballarat took over the orphanage in the late 1880's and moved the children to Ballarat but the school continued to develop an expanding curriculum. A chapel was built in 1887 and a school wing in 1906. They survived on tuition fees and the generosity of benefactors though the early and middle part of the 20th century including a large bequest by Mrs Vera Kenna in the 1960's. Boarders were a regular part of convent life until the 1970's which is probably the source of this plate. St Ann's College was combined with St Joseph's CBC college as Emmanuel College and operates today as the largest Catholic college in the district.This has significance as it is associated with one of the longest running schools in the district and hence would have a connection to many Warrnambool people as well as district people who boarded at the college.White bowl, with green and yellow stripe around edge and emblem. Childers Cove is situated about 15 ks east of Warrnambool in the area known as Mepunga. It is named after the shipwreck of 'The Children.The documents relate to the running of the Childer's Cove Progress Association. There are a number of social activities including gymkhanas, racing meetings, making of roads and improving with planting trees There are many names which are still familiar with the area nearly 100 years later, including Wallace, McDowall, Burleigh, Murnane, Bonnett, Abraham Laidlaw Keogh Holloway and Palmer. Some of the meetings were held at the Mepunga South School with others held at Eckers Hotel Warrnambool and some at the race course. Fundraising events were held also from athletic meetings and district school children's races. This collection of papers is representative of many small communities around Australia where people came together and worked to improve their community facilities. This booklet gives the Rules and Regulations and the Scale of Fees for the Warrnambool General Cemetery as from 1902. The booklet rescinded the Rules and Regulations of 1855 and amongst the 1902 Rules it is noted that no catacombs or wooden structures were allowed by the Trustees. It was also noted that no child under ten was permitted into the cemetery grounds unless under adult supervision. The charge for an adult burial was £1 and ten shillings for a child under ten. The Warrnambool Cemetery is in Otway Road, Warrnambool and was first gazetted in 1853 with Mr Whittet as the first Sexton. This booklet is of considerable interest because it gives the Rules and Regulations and the Scale of Charges of the Warrnambool General Cemetery as laid down in 1902. The Trustees at the time were William Ardlie, a prominent Warrnambool lawyer, Samuel Nettleton, a well-known Warrnambool shopkeeper and J.H.Allan, a member of a pioneering family in the Warrnambool district. This is a small booklet containing the Rules and Regulations of the Warrnambool General Cemetery. It contains four double-sided pages with printed material on all of the pages. The cover is pale yellow and the printing on the front cover has a black edging. There is some silverfish damage on the page edges. These two important books are part of a series produced in the 1880s but they have widely-different content. One describes the natural history of the Parish of Selborne in the County of Hampshire in England. It was written by the British naturalist and ornithologist, Gilbert White and first published in 1789. Since that time it has been republished over 300 times right up to the present day. It is notable for its charm and simplicity and for its description of a pre-industrial England. The other is by the American author, Walt Whitman, first published in 1871. It is a major work of comparative politics and expounds on the influence of the Louisiana Purchase and the expansion of the American spirit and character. It also denounces the post-Civil War materialism that had spread at that time in America. These books are of interest because of their antiquarian nature but they are mostly of local Warrnambool interest because of their inscriptions. The books belonged to William Hugh McMahon (1862-1936). William McMahon commenced a legal practice in Warrnambool in 1894, firstly in Liebig Street and later in Kepler Street. He was a prominent lawyer in Warrnambool for 30 years and a staunch adherent of the Presbyterian Church. He and his family lived at ‘Glenrye’ at the corner of Ardlie Street and Botanic Road, a site where the St. John of God Hospital was later established. These two accompanying volumes are in the Camelot Series (1887 and 1888). They are hard cover books with red covers and two ornamental patterns on the front cover (stylized urn and fan shapes). The urn pattern is repeated on the spines. ‘The Natural History of Selborne’ has 366 pages (a Preface and Chapters on the Natural History of Selborne, a Naturalist’s Calendar and Observations on Various Branches of Natural History) and ‘Democratic Vistas’ has 175 pages (a Preface and 12 Chapters). The latter has the remains of a label stuck to the front cover.
