Edward (Edmund) de Lacy Evans was really Ellen Tremaye; and in 1856 she married her fellow passenger on her voyage to Australia, Mary Delahunty; under the assumed name of EDMUND De Lacy. In 1859 he/she married Sarah Moore. They were married for eight years when in 1867 she died in childbirth. In 1868 after Sarah had died; Ellen, now known as EDWARD de Lacy Evans married Julia Mary Marquand in Ballarat. The De Lacy Evans case has created great excitement here. The man-woman having resided in the district for about 20 years, was well known amongst the miners, but no one appeared ever to have supposed that she was other than as she represented herself to be, and the discovery of her sex has caused the greatest astonishment. The police have not yet moved in the matter of the discovery of her antecedents, but from the result of inquiries I have made, there seems to be no room to doubt that the woman is identical with the girl Ellen Tremaye, referred to in yesterday's telegram as having arrived at Melbourne by the ship Ocean Monarch in June, 1857. The nurse at the hospital, Mrs. Holt, is positive she is the same, and says the opinion was held amongst those on board the vessel that Tremaye had been well connected, and that she had left home in consequence of some misconduct. The Ocean Monarch was an immigrant vessel, and on the voyage Tremaye and another young woman, named Rose Kelly, were very intimate, but the latter, being seized with a dangerous illness, was left at Rio Janiero. Mrs. Evans, the wife of the supposed man, states that she frequently heard Evans say that she came out by the Ocean Monarch. But the most satisfactory information of Evans' previous history yet received has been obtained from a Mrs. Thompson, a charwoman at Myers' Creek, who was also a shipmate of the girl Tremaye. At the time she made the voyage she was unmarried, and was accompanied by Miss Mary Ann Delahunty, a young lady who was very well connected, and who came from the same village as herself, named Monakine, on the north bank of the river Suir, in Kilkenny. Miss Delahunty was an orphan and brought with her about £900. After Rose Kelly was taken ill, Tremaye resorted to Miss Delahunty's berth, and the passengers appeared to think there was something strange about the manner in which Tremaye conducted herself, and she had been observed to wear a man's under-clothing. Upon the arrival of the ship in Hobson's Bay, Tremaye declared herself to be a man, and told Mrs. Thompson she intended to marry Miss Delahunty. The next Mrs. Thompson saw of Ellen Tremaye was at Peg-leg Gully, Eaglehawk. Tremaye had just established herself in a house there under the name of Edward de Lacy Evans, and Mrs. Thompson went to serve them with milk. When she went to the house, she saw Evans sitting inside dressed in male attire, and immediately recognised him as her fellow passenger, Ellen Tremaye. Evans had, at this time, married his second wife, Miss Moore, who was then present. Evans re-marked to her—"I think I know you." To which Mrs. Thompson replied—"I know you, too," and added something to the effect that Ellen (referring to Tremaye) was a queer girl." Oh, said Evans, evidently anxious that his then wife should not understand Mrs. Thompson's reference, "It's a good job she is gone back to the old country." Mrs. Thompson inquired as to what had become of Miss Delahunty, and Evans replied, "Oh, my poor wife and boy both died of consumption, and are buried in the North Melbourne cemetery. " In reply to an inquiry as to what had been done with her (Delahunty's) money, Evans said she had sent it home to a nunnery. Evans's then wife had been absent during a portion of this conversation, but at this point she returned, and Evans went outside to the milkwoman, and said, "For your life don't mention my dead wife's name ; call me Mr. Evans. This missus of mine is death on the Roman Catholics, and she can't bear to hear my dead wife's name mentioned." This conversation took place about 12 or 14 years ago, and Mrs. Thompson seems to have quite believed that Evans had personated a woman under the name of Ellen Tremaye on the voyage out and was really a man. The Freedom of Entry to the City was an honour conferred by the Bendigo City Council to the Army Survey Regiment in 1970. 1980 was the third time the unit exercised its freedom of marching into the city with swords drawn, bayonets fixed and drums beating. The honour is usually bestowed upon local regiments, in recognition of their dedicated service, and it is common for military units to periodically exercise their freedom by arranging a parade through the city. Led by the Regiment’s CO – LTCOL Bob Skitch, the unit marched down View St in the CBD, along Pall Mall and up Gaol Rd to the Queen Elizabeth II Oval. The ceremonial parade followed with a march past the guests of honour, Mayor of Bendigo Councillor Paul Tomkinson and military dignitaries. The parade concluded after formal inspections of the troops. The Regiment also exercised its Freedom of Entry with anniversary parades in 1977, 1980, 1985, 1990 and 1995. On August 12, 1902, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented it is made known that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he was unable to secure at Eltham a suitable house in which to carry on his business, but he was building a place near the railway station which he expected to be done in about three weeks time, at which time he would give up possession of the bakery. Mr Smallman informed the defendant, Luther Haley, that he would have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction refered to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. In June 2024 Annie Hackrath shared a memory of living in the old bakery: "My husband and I lived in the old bakery for 18 months in 1978-9 , husband Geoff used the old bakery out the back as a wood workshop, making turnery and handcrafted furniture. The front shop was operated as a “sometimes” art gallery which we called “Gouge and Grain”. There were old sheds against the back fence which we thought were probably stables from the bakery days. Lovely memories of the old place which had so much character and seemed to attract a multitude of interesting creative people! [article by Bettina Woodburn in EDHS Newsletter No. 105, November 1995:] EXPLORING THE UPPER YARRA - We enjoyed the Spring Excursion, this year "Exploring the Upper Yarra" - in spite of the constant rain and the countryside under the cloud cover, especially in the valleys, being mainly shiny shades of green. The occasional fields of buttercups, clumps of arum lilies and splendid rhododendron and other flowering bushes became very special. The Cobb and Co coach was warm and a cosy retreat as we zig-zagged on the highways and byways to glimpse the Yarra River, upstream and down, its secret places, and particularly the many bridges. Russell excelled as 'Poet Laureate', reading from Dacre Smyth's book. This 1979 publication includes paintings of all the bridges along the river with poems and brief descriptions of each one. Some of the bridges are in out-of-the-way places and are not very well known. We looked forward to hearing the poetry as much as seeing the 'constructions'… Big Pat (was he short or tall, lean or fat? - he did win the £200 reward for discovering gold and had the creek named after him), about the 'Eddies'?, and the disliked 'meccano' bridge in Warburton, etc. etc. The hot roast lunch in the old Reefton Hotel was also most welcome. It was easy to imagine it peopled by miners and early settlers. Starting by crossing the new (1974) concrete bridge at Warrandyte we headed through Wonga Park with views to the Christmas Hills and to the escarpment of the Yering Gorge, which causes flood waters to back up through the Yarra Glen plain, so avoiding disasters downstream. At the end of a long driveway we found the wooden, privately owned Henley Bridge (1935 after the 1934 floods). This facilitates access to different parts of Henley Farm and to Lilydale. Everard Park, named after Blanche Shallard's father, a State Member for 17 years, below the Highway Yarra crossing was in need of care. It is 10 miles from Yarra Glen by road but, as "Yarra Marra” canoeists well know, 32 winding miles down by water. After more delightful countryside scenes we joined the Warburton Highway at Woori Yallock. From the old Railway Station at Launching Place the Centennial Trail for walkers, cyclists and horse riders has replaced the rails. The line from Lilydale was opened in 1901, and the last diesel freight train ran to Warburton in 1965. It continued to rain as we had morning tea in Warburton in a shelter between footbridges. From here we continued upstream past the Bridge to O'Shannassy Lodge and Reservoir, Starvation Creek, and the Peninsular tunnel (miners dug it as at Pound Bend) which we visited (scrambling down those steps!) on our return after lunch. Our furthermost point was the Upper Yarra Dam Reserve (and vast catchment area). Finished in 1957 after ten years' work and 100 years after Yan Yean, it supplies much of Melbourne's water. After crossing the 30m Launching Place Bridge to the Eltham side of the Yarra and Healesville, we saw in the distance the Yarra Glen Timber Trestle Bridge over the river flats "the longest for years in the land it was said!" Harry's dream of "better weather over the Divide" unfortunately didn't come true, but I'm sure we 36 members will retain happy memories of a day that was wet and green and filled with Bridges. Situated on the Yarra River, 5.5 kms south of Christmas Hills on private property. This timber trestle bridge is said to have been built some time after 1907 by Melbourne master-builder, David Mitchell (the father of Dame Nellie Melba), to connect his two "Henley Farm" properties with Lilydale. In earlier days, when the McPhersons owned the property, their children used a punt to cross the river to attend Yering Primary School. The Orford family, a pioneer family remained continuously living and working in Eltham for 170 years from 1854 to 2024. James and Sarah Orford arrived in Sydney in 1839 aboard the ship “Orestes”; they had several children there before settling in Eltham in 1854. Three children, James Mathias, Sarah Amelia and Thomas Henry initially remained in the Eltham area. James eventually moved to Brunswick. Sarah married Arthur Butler Young and finally lived in Bunyip. Thomas who was six years old when the family arrived in 1854 remained in Eltham, married Helen Logan who died, leaving a large family. They lived in a slab hut by the Yarra at Laughing Waters and Thomas managed the Panton Park Estate, a selection owned by Magistrate Thomas Panton. Thomas’s son, Ernest Orford was born 1892 at Pitt Street, Eltham and also lived his entire life in Eltham working as a labourer, orchardist and later as a gardener and grounds keeper for Sir William Irvine, a former Chief Justice and Premier of Victoria. Ernest married Kate Thomas; their two sons Ron and Doug stayed in the area. Another of Thomas' sons, Arthur, also lived in Eltham. Four Orford generations attended Eltham schools. Doug Orford was born on the kitchen table (reference, son Ted Orford) of the family home at the corner of Reynolds Road and Mount Pleasant Road. Doug married Gwen and they established a family however Gwen died at a young age from cancer. Doug eventually remarried another Gwen and they lived for several decades in Napoleon Street, Eltham. Doug was actively involved in EDHS over many years, including serving as a committee member and vice president. Contributions by Doug and Gwen, his wife, assisted EDHS to continue to develop as a not-for-profit group intent on promoting and preserving our local history. Both Doug and Gwen were made Life Members of EDHS. His significant work with assisting to establish our valued Local History Centre helped develop our home base and supported the continued growth of our society. Doug’s local knowledge, suggestions and family connections were highly valued, Until recent times, he continued to regularly attend our Collections Team workshops providing his insights and historical information about photographs and society records. Doug died peacefully July 8, 2024, and represents the last link in the Orford Eltham chain which spanned 170 years. This is a set of seven photographs of personnel posted to the Army Survey Regiment in 1989. These formal group photos of three of of the four Squadrons, Officers, and Warrant Officers/Sergeants were probably taken after a CO’s Parade. There were no photos of Headquarters Squadron in this set of negatives. LTCOL John Winzar was the CO of the Army Survey Regiment from 1987 to 1989 and WO1 Neville Stone was the RSM from 1988 to 1990. The Freedom of Entry to the City was an honour conferred by the Bendigo City Council to the Army Survey Regiment in 1970. 1980 was the third time the unit exercised its freedom of marching into the city with swords drawn, bayonets fixed and drums beating. The honour is usually bestowed upon local regiments, in recognition of their dedicated service, and it is common for military units to periodically exercise their freedom by arranging a parade through the city. Led by the Regiment’s CO – LTCOL Bob Skitch, the unit marched down View St in the CBD, along Pall Mall and up Gaol Rd to the Queen Elizabeth II Oval. The ceremonial parade followed with a march past the guests of honour, Mayor of Bendigo Councillor Paul Tomkinson and military dignitaries. The parade concluded after formal inspections of the troops. The Regiment also exercised its Freedom of Entry with anniversary parades in 1977, 1980, 1985, 1990 and 1995.These black and white photographs of the Army Survey Regiment were taken on the occasion of the Freedom of Entry parade to the City of Bendigo in 1980. The photographs were printed on photographic paper and are part of the Army Survey Regiment’s Collection. Edward was born in 1919 and had studied at the National Gallery of Victoria. In 1958 he was head of the painting section of the Royal Melbourne Technical College (now RMIT) and had only recently begun experimenting with mosaic. The Centennial mosaic covers a wall 68 feet (20.72 metres) in length and 14 feet (4.26 metres) high. Edendale Farm is Nillumbik Shire Council's environment centre situated in Gastons Road, Eltham between the railway and the Diamond Creek. The homestead on the property was built in 1896 and is of historical significance, being the subject of a Heritage Overlay under the Nillumbik Planning Scheme. The Edendale property was originally part of an extensive land purchase in 1852 from the Crown by pioneer Eltham farmer Henry Stooke. He initially purchased 51 acres and later expanded his holdings by purchasing another three adjacent Crown allotments extending northerly from Josiah Holloway's Little Eltham subdivision. Despite clearing the land, Stooke did not build on this property, choosing to live on his property "Rosehill" at Lower Plenty. In 1896 Thomas Cool, Club Manager of the Victoria Coffee Palace in Melbourne purchased 7 acres of the original Stooke land and built the house now known as Edendale. Cool did not farm the land, instead using it as a gentleman’s residence, retiring to Eltham at weekends. In 1918 he purchased an additional 7 acres but in 1919 he sold the property. Later owners included J.W. Cox, the Gaston family and D. Mummery. In the 1980s the Eltham Shire Council purchased the site for use as a Council depot, but this use did not proceed. Subsequently, it was used as the Council pound. The Edendale Farm Pet Education and Retention Centre was established in the summer of 1988/1989 and was set up to replace the existing dog kennels with a high standard pet retention centre. The design style of the building was established to compliment the features of the existing house. It was equipped with 10 retention pens, a veterinary room and a pet education area where school children and other interested parties learnt about pet care procedures. It was later developed into a community farm and was run by an advisory committee and in 2000 it became an Environment Centre. In early 2006 an advisory committee was established for the development of a master plan for future development at Edendale Farm. The committee included Russell Yeoman, a former long-time shire planner and founding member of the Eltham District Historical Society. At the time of filming the Master Plan and future for Edendale was about continuing to develop Edendale as a centre of environment learning and looking at expanding displays and school program, running a lot more of life-long learning and workshops around sustainable living. Only 1.4 km from Eltham’s centre, sheep feed, blissfully unaware of the hectic suburban activity so close by. At the entrance to the 5.6ha Edendale Farm is another surprise. A work of art that looks like huge tree trunks transformed into bowler and top-hatted men. The Fences Act 1968 by Tony Trembath with Mark Cain and John Doyle, 1996, is classified by the National Trust of Australia as having Regional Significance. The title refers to a government act on disputes between neighbors over the placement of fences and boundaries. This takes a ‘wry swipe’ at a community divided by trivial squabbles. It also celebrates making do with limited resources.1 Further along on the left, the office wall is decorated with a massive Eltham Copper Butterfly, designed by Robert Tickner and made by school children with used plastic bottles and other waste material. Nillumbik Council runs Edendale as an Environmental Education Centre, to help preserve and enhance the local environment. As early as 1988 the former Eltham Shire Council realised Edendale’s importance in meeting people’s needs, particularly of children, to enjoy farmland. The centre, with the Eltham North Reserve to the north - including remnant bushland and open parkland - makes up the major part of the public open space for this area. The council considers this area will become increasingly important to the local community for recreational use.2 Educational programs aim to encourage community involvement to ensure the long-term rehabilitation and protection of natural bushland areas. Edendale is used by people of all ages - from school children to adults - for environmental programs and workshops, as well as for recreation, to enjoy the domestic animals and to picnic. Edendale is also home to the Environmental Works staff who manage reserves and roadsides and support Nillumbik Friends environmental groups. The Friends propagate plants at the nursery, which grows indigenous plants and sells these to the public.3 The centre demonstrates the sustainable living the farm teaches, with features like solar hot water and drive lighting and for the fireplace, logs of recycled cardboard. Edendale has had a varied history as a dog pound and even as a retreat for Thomas Cool, Club Manager of the Victoria Coffee Palace in Melbourne. His single-storey weatherboard house built in 1896, which still stands, was grander than most homes in Eltham. Although such buildings were common in many other parts of Melbourne, Eltham’s poverty and remoteness did not encourage such construction. The Victorian rectangular-shaped house, with a corrugated iron roof and veranda, has elegant large rooms, leadlight windows, ceiling roses, two bay windows and ornately carved wooden fireplace surrounds. Cool bought seven acres (2.8ha) from pioneer Eltham farmer Henry Stooke’s 200 acre (81ha) farm, which he had bought from the Crown in 1852. In 1918 Cool bought an extra seven acres (2.8ha) but in 1919 sold the estate to farmer John Cox. In 1933 Cox sold Edendale to Mrs Elizabeth Gaston, after whom the road leading to the centre was named. The property was owned by several Gaston family members, who called it Edendale, then by a police constable, Douglas Mummery, until the Shire of Eltham bought it in 1970. Oddly Edendale was known as Mummery’s for almost 20 years, although Mummery owned it only for a short time.4 The shire used Edendale as a dog pound until amalgamation with other municipalities in 1996. The pound then moved to the Yan Yean Road, Plenty site, which had been used by the former Diamond Valley Shire Council. To the west and north the centre is bounded by Diamond Creek and on the east by the Melbourne-Hurstbridge railway line. Part of the Research creek forms the centre’s southern boundary.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The cover has been embossed with a the blue grey in swirls. Inside of back cover is a white label, "A New Star Product", with a please ask for No. with "425" stamped on. Postcards have been glued into the album. Entries have been kept to a single line - cards are able to be dated from buildings, whether the trams have marker lights, types of motor cars and general Melbourne history. The Ballarat School of Mines was established in 1870 through the initiatives of the Ballarat Mining Board making it the oldest site of technical education in Australia. The Board was concerned with the shortage of mine managers for the goldfields. Classes began in surveying, mathematics, and chemistry and a decade later they included metallurgy , assaying and geology. With the decline in goldmining the direction of the college changed and broadened, the art School was established and the Ballarat Junior Technical School developed. In 1976, the tertiary sector seperated from the School of Mines and Industries Ballarat to form the Ballarat College of Advanced Education. In the 1980s SMB was a Community College of Technical Education and Further Education (TAFE) offering a wide range of vocational, enrichment and preparatory programs. It is continuing the tradition of providing for the educaiton needs of people within the Central Highlands. During the 1970s and 80s it acquired and refurbished old buildings and developed new facilities to keep up with the needs of an expanding curriculum and student population. These 34 photographs were taken at Flag Day, an annual sports competition between the Army Survey Regiment and the School of Military Survey (SMS) at Latchford Barracks, Bonegilla in May 1990. The two RASvy units took turns each year to host the event. The day competition usually comprised basketball, cross country, golf, sailing, squash softball, tennis, touch football, tug-of-war and volleyball. The evening competition often included darts, carpet bowls, hookey, quoits and snooker. The Flag handover and speeches were held in SMS’s Café Slater recreation/morning tea area. It is not clear which RA Svy unit was the winner.This is a set of 34 photographs were taken at Flag Day, an annual sports competition between the Army Survey Regiment (ASR) and the School of Military Survey (SMS) at Latchford Barracks, Bonegilla in May 1990. It lies just beyond the eastern end of Pitt Street, south of Nyora Road to the northern end of Eucalyptus Road and extends east from Eucalyptus Road to Reynolds Road. The topography of CA15 is generally steep, sloping up to a hill near the centre of the land, the ridgeline passing through the properties along the southern side of Diosma Road. Eucalyptus Road is a straight north-south road with its northern end at the north west corner of CA15. Until the end of the 1970s this road was an un-named Government Road and was largely not open to traffic. With residential development in the 1970s the road was constructed, and the council allocated the name obviously in recognition of the predominant species of the local bushland. CA15 was purchased from the Crown by George D’Arley Boursiquot, a prominent Melbourne printer, on 28th October 1852. On November 23, 1922, former Member for Gippsland and Melbourne Real Estate Agent, Hubert Patrick Keogh purchased the allotment then sold it March 13, 1925, to local farmer, Robert David Taylor, a former Shire of Eltham Councillor (1911-1920) and Shire President (1919). Taylor had extensive land holdings stretching west towards Bible Street and Main Road. The Taylor home was situated at the top of the hill in Bible Street at present day 82 Bible Street. At the time of Taylor’s purchase in 1925, CA15 was subdivided into 48 lots that could be described as small rural properties or large residential lots. A typical lot size was one hectare or 2.5 acres. The subdivision created two roads, Nyora Road, and Diosma Road, each following an irregular alignment between Eucalyptus and Reynolds Roads. However, the lots were not sold off separately nor were the roads constructed. The land effectively remained as one parcel for many further years. Robert David Taylor died November 30, 1934, and probate was granted to his son of the same name, Robert David Taylor of Bible Street, Salesman and William McLelland Vance Taylor of 73 Emmeline Street, Northcote, Clerk, with the transfer of the land into their names on July 8, 1935. Frank Stokes worked as a qualified accountant at Kennons leather factory in Burnley, while living at 1 Thomas Street, Mitcham. He suffered from migraines and wanted to return to working the land (he had previously worked on farms and orchards since coming to Australia from England in 1926, both in WA and Vic.). He first travelled to the district by train in July 1942 to find land with the intention to establish an orchard. By chance he met Arthur Bird of Bird Orchard (bounded by Pitt Street, Eucalyptus Road, and Wattle Grove) and they got talking over their common interest. Arthur put Frank up for the night and pointed out the land, 158 acres- part of the Taylor Estate- £900, Crown Allotment 15, Section 5, Parish of Nillumbik (CA15) somewhat diagonally opposite Bird Orchard. Stokes applied through the Riverina Agency to purchase the land who in turn applied for permission from Canberra to sell as there was a new government regulation introduced during the Second World War banning land sales except for immediate production. Stokes obtained a loan on his Mitcham house of £600 @ 5% and paid £450 deposit with quarterly payments of £15 spread over 5 years. Stokes was assisted and advised by Arthur Bird who farmed the neighbouring orchard. In early 1943 Stokes took possession and would catch the train out to Eltham on Fridays after work and began building a hut on the corner of Nyora Road and the Government Road (Eucalyptus Road) for shelter and to lock up tools. He established an orchard on the central western part of the land through the centre of which ran a natural waterway (part of the present-day linear park) and was able to pay a neighbour (Hawkins) to help with clearing and fencing 25 acres, and with a horse and single furrowed plough, planted approximately 2,500 fruit trees - cherries, peaches, plums, almonds, pears, apricots and lemons as well as a few apples and oranges; a massive task. Aerial photographs from the 1940s through to the 1990s clearly show the orchard with most of the larger CA15 site remaining as natural bushland. A huge problem was hares and rabbits eating all the new buds off the tiny trees. As well as laying poison he painted the trees with a mixture of cow manure and lime, often working by moonlight. Procurement of wire and wire netting was difficult because of the war but after much effort he obtained a permit from the Agricultural Department for supplies in March 1944. In February 1945 Stokes applied for a permit to build a “packing shed” as no house building was allowed. It was to be 33 feet x 21 feet and cost £312. It was constructed mostly from second-hand materials, which were hard to obtain, especially iron for roofing. Stokes finished work at Kennons on October 31, 1945, and in March 1946 he sold the family home at Mitcham for £1,230 plus £170 for furniture. On May 15, 1946, title to the CA15 property was issued to Frank Howard Alfred Stokes, Orchardist and Gladys Ethel Stokes, Married Woman, both of Pitt Street, Eltham. The family of five then moved into the very unfinished “packing shed” at Eltham, which was a struggle to weatherproof. Eventually rooms were divided off and lined with hessian bags and whitewashed. Their income was firewood (cut and sold), selling rockery stones and cut Sweet Bursaria. (It was discovered during the 1940s that Sweet Bursaria contained the sunscreen compound Aesculin. The RAAF utilised this compound from Sweet Bursaria during WW2 for pilots and gunners.) The orchard’s first fruit sale was a half-case of Le Vanq peaches in December 1947 for the price of 8 shillings. In 1956 plans for house were drawn and Glen Iris bricks purchased (1956 Olympic Rings variant). The building of the house commenced in 1957 - 12 feet of original packing shed was removed – and was completed in 1959. Water was connected from newly built pressure storage on the property at the end of 1959 and the electricity connection for the first time at 3pm on April 29, 1960. The house remains to present day (somewhat modified) at 1 Nyora Road, home to Nyora Studio Gallery. On occasions, spare remnants of the 1956 bricks have been known to be unearthed in gardens on the estate as they were utilised by Frank Stokes to fill in rabbit holes. On May 26, 1950, a parcel of land was compulsorily acquired by the Melbourne and Metropolitan Board of Works on the hilltop to establish an easement for a high-level service reservoir to augment Eltham’s water supply. On November 27, 1964, the State Electricity Commission served notice to compulsorily acquire a further parcel through the eastern part of the land for a major electricity transmission line that augmented supply from the La Trobe Valley to Melbourne. The easement was registered February 11, 1966. The easement was widened July 18, 1969 for a second transmission line to be constructed. In 1971 Melbourne Metropolitan Planning Scheme amendments adopted Nyora Road as the boundary between a residential zone to the north and a rural zone to the south. This determined the future development of the land. In the mid-1970s the Shire of Eltham divided the orchard into numerous rate-able parcel lots, the 48 lots having been established in 1925 and the subsequent rates assessment proved unsustainable for Stokes. He commenced selling lots outside the boundary of the orchard, north of Diosma and South of Nyora. However shortly later the land between Nyora and Diosma Roads and west of the electricity easement was sold and subdivided into residential lots, a housing development by Macquarie Builders and marketed as the Stokes Orchard Estate. New streets were created, and most were named after trees, although one, Stokes Place, commemorates the former owners. The development was undertaken in two stages; Stage 1 (1975) encompassing Scarlet Ash Court, Ironbark Close and Peppermint Grove bounded by Nyora and Eucalyptus roads and Stage 2 (1978) encompassing Stokes Place, Orchard Way, The Crest and The Lookout bound by Nyora and Diosma roads. The developer, Macquarie Builders went bankrupt shortly after the release of Stage 2 leaving many purchasers to fend for themselves and arrange for their own independent builders. There were also difficulties with sewerage for the land immediately south of Diosma Road and so the conventional residential lots were abandoned in favour of larger lots. The development of Orchard Way, The Crest and The Lookout did not proceed as planned and the proposed lots were incorporated into five-acre parcels instead. These included a low-density group housing development by the Graves family and the award winning Choong House (1983) with Gordon Ford developed garden immediately next door situated on the ridge of the hill nestled amongst the original bush, Eucalypt trees and Sweet Bursaria. In 1994, Nillumbik Shire Council applied Significant Environment and Significant Landscape overlays upon the properties on the south side of Diosma Road to ensure protection of this natural bush garden environment. With the arrival of the sewer along Diosma Road in the 1990s, most of these five-acre parcels have since been subdivided multiple times. The Choong house presently sits on a 2.7-acre property, which in 2022 Nillumbik Council nominated for Cultural Significance Heritage protection and is considered potentially significant at State level. The Stokes family were also associated with the Eltham Christian Church. In the 1970s this church had met in temporary premises in Eltham. Lots of the original 1925 subdivision remained south of Nyora Road and a number of these lots were utilized for the Eltham Christian School, which was established by the Eltham Christian Church in 1981. The school operated on this site until 2000. The premises are now used by The Vine Baptist Church. By the mid-1980s the whole of CA15 had been developed for residential and school purposes, except for the sections north of Diosma Road and between the transmission lines and Reynolds Road. Sewerage issues had been resolved for the section north of Diosma Road and in 1987 it was in the process of being subdivided into residential lots. The development coincided with the discovery of colonies of the rare and endangered Eltham Copper Butterfly on the site. This resulted in a community and political campaign to save the butterfly habitat. With the co-operation of the land developer the subdivision was altered to create two bushland reserves in the critical butterfly habitat areas. In the late 1980s the State Government was investigating options for establishing a metropolitan ring road link between Diamond Creek and Ringwood. The chosen route was adjacent to Reynolds Road and so this created a freeze on development of CA15 between Reynolds Road and the electricity easement. The ring road proposal was eventually abandoned, and this part of the land was subdivided into low density residential lots. Diosma Road has been discontinued at the electricity easement and the eastern part incorporated into View Mount Court with access from Reynolds Road. The whole of CA15 has now been developed for residential or associated purposes, ranging from conventional density to quite low density south of Nyora Road. Some remnants of the orchard remain, a few cherry trees on the Graves property and a lone apple tree in Stokes Place. The butterfly reserves comprise significant areas of remnant bushland. Linear reserves through the estate link with central Eltham via the Woodridge linear reserve and with Research along the electricity easement. CA15 as it exists today has a complicated history of rural use, Government acquisition, urban development, and community action. In 1994, Nillumbik Shire Council applied Significant Environment and Significant Landscape overlays upon the properties on the south side of Diosma Road to ensure protection of this natural bush garden environment. With the arrival of the sewer along Diosma Road in the 1990s, most of these five-acre parcels have since been subdivided multiple times. The Choong house presently sits on a 2.7-acre property, which in 2022 Nillumbik Council nominated for Cultural Significance Heritage protection and is considered potentially significant at State level. The Stokes family were also associated with the Eltham Christian Church. In the 1970s this church had met in temporary premises in Eltham. Lots of the original 1925 subdivision remained south of Nyora Road and a number of these lots were utilized for the Eltham Christian School, which was established by the Eltham Christian Church in 1981. The school operated on this site until 2000. The premises are now used by The Vine Baptist Church. By the mid-1980s the whole of CA15 had been developed for residential and school purposes, except for the sections north of Diosma Road and between the transmission lines and Reynolds Road. Sewerage issues had been resolved for the section north of Diosma Road and in 1987 it was in the process of being subdivided into residential lots. The development coincided with the discovery of colonies of the rare and endangered Eltham Copper Butterfly on the site. This resulted in a community and political campaign to save the butterfly habitat. With the co-operation of the land developer the subdivision was altered to create two bushland reserves in the critical butterfly habitat areas. In the late 1980s the State Government was investigating options for establishing a metropolitan ring road link between Diamond Creek and Ringwood. The chosen route was adjacent to Reynolds Road and so this created a freeze on development of CA15 between Reynolds Road and the electricity easement. The ring road proposal was eventually abandoned, and this part of the land was subdivided into low density residential lots. Diosma Road has been discontinued at the electricity easement and the eastern part incorporated into View Mount Court with access from Reynolds Road. The whole of CA15 has now been developed for residential or associated purposes, ranging from conventional density to quite low density south of Nyora Road. Some remnants of the orchard remain, a few cherry trees on the Graves property and a lone apple tree in Stokes Place. The butterfly reserves comprise significant areas of remnant bushland. Linear reserves through the estate link with central Eltham via the Woodridge linear reserve and with Research along the electricity easement. It lies just beyond the eastern end of Pitt Street, south of Nyora Road to the northern end of Eucalyptus Road and extends east from Eucalyptus Road to Reynolds Road. The topography of CA15 is generally steep, sloping up to a hill near the centre of the land, the ridgeline passing through the properties along the southern side of Diosma Road. Eucalyptus Road is a straight north-south road with its northern end at the north west corner of CA15. Until the end of the 1970s this road was an un-named Government Road and was largely not open to traffic. With residential development in the 1970s the road was constructed, and the council allocated the name obviously in recognition of the predominant species of the local bushland. CA15 was purchased from the Crown by George D’Arley Boursiquot, a prominent Melbourne printer, on 28th October 1852. On November 23, 1922, former Member for Gippsland and Melbourne Real Estate Agent, Hubert Patrick Keogh purchased the allotment then sold it March 13, 1925, to local farmer, Robert David Taylor, a former Shire of Eltham Councillor (1911-1920) and Shire President (1919). Taylor had extensive land holdings stretching west towards Bible Street and Main Road. The Taylor home was situated at the top of the hill in Bible Street at present day 82 Bible Street. At the time of Taylor’s purchase in 1925, CA15 was subdivided into 48 lots that could be described as small rural properties or large residential lots. A typical lot size was one hectare or 2.5 acres. The subdivision created two roads, Nyora Road, and Diosma Road, each following an irregular alignment between Eucalyptus and Reynolds Roads. However, the lots were not sold off separately nor were the roads constructed. The land effectively remained as one parcel for many further years. Robert David Taylor died November 30, 1934, and probate was granted to his son of the same name, Robert David Taylor of Bible Street, Salesman and William McLelland Vance Taylor of 73 Emmeline Street, Northcote, Clerk, with the transfer of the land into their names on July 8, 1935. Frank Stokes worked as a qualified accountant at Kennons leather factory in Burnley, while living at 1 Thomas Street, Mitcham. He suffered from migraines and wanted to return to working the land (he had previously worked on farms and orchards since coming to Australia from England in 1926, both in WA and Vic.). He first travelled to the district by train in July 1942 to find land with the intention to establish an orchard. By chance he met Arthur Bird of Bird Orchard (bounded by Pitt Street, Eucalyptus Road, and Wattle Grove) and they got talking over their common interest. Arthur put Frank up for the night and pointed out the land, 158 acres- part of the Taylor Estate- £900, Crown Allotment 15, Section 5, Parish of Nillumbik (CA15) somewhat diagonally opposite Bird Orchard. Stokes applied through the Riverina Agency to purchase the land who in turn applied for permission from Canberra to sell as there was a new government regulation introduced during the Second World War banning land sales except for immediate production. Stokes obtained a loan on his Mitcham house of £600 @ 5% and paid £450 deposit with quarterly payments of £15 spread over 5 years. Stokes was assisted and advised by Arthur Bird who farmed the neighbouring orchard. In early 1943 Stokes took possession and would catch the train out to Eltham on Fridays after work and began building a hut on the corner of Nyora Road and the Government Road (Eucalyptus Road) for shelter and to lock up tools. He established an orchard on the central western part of the land through the centre of which ran a natural waterway (part of the present-day linear park) and was able to pay a neighbour (Hawkins) to help with clearing and fencing 25 acres, and with a horse and single furrowed plough, planted approximately 2,500 fruit trees - cherries, peaches, plums, almonds, pears, apricots and lemons as well as a few apples and oranges; a massive task. Aerial photographs from the 1940s through to the 1990s clearly show the orchard with most of the larger CA15 site remaining as natural bushland. A huge problem was hares and rabbits eating all the new buds off the tiny trees. As well as laying poison he painted the trees with a mixture of cow manure and lime, often working by moonlight. Procurement of wire and wire netting was difficult because of the war but after much effort he obtained a permit from the Agricultural Department for supplies in March 1944. In February 1945 Stokes applied for a permit to build a “packing shed” as no house building was allowed. It was to be 33 feet x 21 feet and cost £312. It was constructed mostly from second-hand materials, which were hard to obtain, especially iron for roofing. Stokes finished work at Kennons on October 31, 1945, and in March 1946 he sold the family home at Mitcham for £1,230 plus £170 for furniture. On May 15, 1946, title to the CA15 property was issued to Frank Howard Alfred Stokes, Orchardist and Gladys Ethel Stokes, Married Woman, both of Pitt Street, Eltham. The family of five then moved into the very unfinished “packing shed” at Eltham, which was a struggle to weatherproof. Eventually rooms were divided off and lined with hessian bags and whitewashed. Their income was firewood (cut and sold), selling rockery stones and cut Sweet Bursaria. (It was discovered during the 1940s that Sweet Bursaria contained the sunscreen compound Aesculin. The RAAF utilised this compound from Sweet Bursaria during WW2 for pilots and gunners.) The orchard’s first fruit sale was a half-case of Le Vanq peaches in December 1947 for the price of 8 shillings. In 1956 plans for house were drawn and Glen Iris bricks purchased (1956 Olympic Rings variant). The building of the house commenced in 1957 - 12 feet of original packing shed was removed – and was completed in 1959. Water was connected from newly built pressure storage on the property at the end of 1959 and the electricity connection for the first time at 3pm on April 29, 1960. The house remains to present day (somewhat modified) at 1 Nyora Road, home to Nyora Studio Gallery. On occasions, spare remnants of the 1956 bricks have been known to be unearthed in gardens on the estate as they were utilised by Frank Stokes to fill in rabbit holes. On May 26, 1950, a parcel of land was compulsorily acquired by the Melbourne and Metropolitan Board of Works on the hilltop to establish an easement for a high-level service reservoir to augment Eltham’s water supply. The project also included pipe tracks for the necessary water mains. The reservoir has now been superseded by higher level water tanks east of Reynolds Road and its former site is now a public reserve. On November 27, 1964, the State Electricity Commission served notice to compulsorily acquire a further parcel through the eastern part of the land for a major electricity transmission line that augmented supply from the La Trobe Valley to Melbourne. The easement was registered February 11, 1966. The easement was widened July 18, 1969 for a second transmission line to be constructed. In 1971 Melbourne Metropolitan Planning Scheme amendments adopted Nyora Road as the boundary between a residential zone to the north and a rural zone to the south. This determined the future development of the land. In the mid-1970s the Shire of Eltham divided the orchard into numerous rate-able parcel lots, the 48 lots having been established in 1925 and the subsequent rates assessment proved unsustainable for Stokes. He commenced selling lots outside the boundary of the orchard, north of Diosma and South of Nyora. However shortly later the land between Nyora and Diosma Roads and west of the electricity easement was sold and subdivided into residential lots, a housing development by Macquarie Builders and marketed as the Stokes Orchard Estate. New streets were created, and most were named after trees, although one, Stokes Place, commemorates the former owners. The development was undertaken in two stages; Stage 1 (1975) encompassing Scarlet Ash Court, Ironbark Close and Peppermint Grove bounded by Nyora and Eucalyptus roads and Stage 2 (1978) encompassing Stokes Place, Orchard Way, The Crest and The Lookout bound by Nyora and Diosma roads. The developer, Macquarie Builders went bankrupt shortly after the release of Stage 2 leaving many purchasers to fend for themselves and arrange for their own independent builders.
