Document, Thomas Smith Probate 1880
Tait collection: item 33 of 62 This probate document gives details of the will of Thomas Smith, a farmer in the Wangoom district who was a pioneer settler, having arrived in the area about 1848. He erected the Shamrock Hotel in Dennington in 1868 and it was opened for business in 1869 with David Duffy as the first licensee. Thomas Smith was the licensee in 1870 and members of his family (Cornelius, Robert and Mary Smith) held the licence of the hotel until 1880. A codicil to the will gave Mary Smith, Thomas’ daughter, the hotel land and building. This hotel closed in 2011. Thomas Smith signed the original will with a cross (his mark). Other names mentioned in the probate document are Frederick Wilkinson, Master-in-Equity, Ernest Chambers, Solicitor, John Drayton, Clerk to E. Chambers, William Ardlie, Senior, Solicitor, Thomas Goodall, Clerk to William Ardlie, Richard Sheldrick, Clerk to William Ardlie, Walter Davies, Stationer.This is a significant document as Thomas Smith was a prominent owner of land, especially in the Dennington area. The Shamrock Hotel in Dennington was built by Smith and still owned by him when he died in 1880. The will gives important details of the estate of Thomas Smith and adds to our knowledge of his life and work. Each page has printed ruled red lines top, bottom and sides and all are tied with green corded string. There are handwritten corrections and signatures, including those of Ernest Chambers, Solicitor of Warrnambool and John Drayton, Clerk to E. John Mann arrived from Forfar, Scotland, on the clipper packet "Ellen Stuart" in 1857 and rented a farm "Overton" at Janefield. Soon after he met Melbourne-born Violet McKimmie, whose parents had a property near Darebin Creek. They married on 25 September 1862, John 26 and Violet 19. In 1874 John selected a block on Arthurs Creek and built a slab and bark hut (still standing in 1984) and called their farm "Carseburn" after John's parish in Scotland. They had seven children: John, Jane, Christine, David, Walter, James and Violet. John was drowned in the Yarra in May 1875 and Violet struggled to meet the lease commitment. She wrote to her brother-in-law David Mann in New Zealand who came to her aid, and on 10 September 1876, they married at the Victorian Free church, Smith Street, Collingwood. They improved the farm and built a three-room house. in July 1883 they bought neighbouring land from Ann Welsh. With David, Violet had four more children: Robert, William and twins Thomas and Henry. In 1883, David died and was buried in the same grave as his brother in Preston Cemetery. The twins also died, Thomas just before and Henry just after their father. the children assisted with the farm and orchard, the business including crops, a dairy herd, Carseburne sheep, and breeding horses. Violet died at Yan Yean in 1925, aged 83. A grandson of John Mann, James Mann, lived in Henry Street, Greensborough and had given a talk at the Whittlesea Historical Society in 1983 on his family. Descendant Lindsay Mann was part of a creative writing group that published a book including a short story "The Mountain Tramway" is loosely based on his childhood and stories he was told then but was planning to write his family story. This etching was created of Camperdown c1850s showing a group of First Nations people and early dwellings and native vegetation around Mounts Leura and Sugarloaf. Camperdown was surveyed by Robert Dunbar Scott in 1851. First dwelling constructed by David Fenton in 1853 on site of Commercial Hotel. Two Classification Reports on Public Art in the City of Caulfield. Permanent Art Collection made by the National Trust of Australia (Victoria) on The Family and Adam and Eve by Karl Duldig with an accompanying letter dated 29/10/1993 to CEO D. Aglen informing him of their placement on the National Trust Register. Also included are a photocopy report of the same nature on the Karl Duldig Artworks in the Kadimah Cultural Centre also included, with a letter.
