December 1916 at Magdhaba Egypt, Mr Justice Higgins HB has a small ...Following the death of his only child Mervin on 23 December 1916 at Magdhaba Egypt, Mr Justice Higgins HB has a small number, possibly as few as six, of memorial books made. He sought permission from Signaller JC Campbell to use a selection of photographs taken at Gallipoli and Egypt. The photographs together with typed copies of several letters written by Captain MB Higgins 8th ALH make up the book. It seems likely this copy of the book was given to the 8th Light Horse Association for safe keeping. Following the closure of the Association the last secretary Mr Matthew Maynes entrusted the book to a relative Mrs Baily to be donated to the 8/13 Victorian Mounted Rifles.This is a rare, historic and artistic example of how one family sought to come to terms with the loss of their only child in the Great War 1914-1918.Leather bound album of 44 leaves containing collection of photographs taken by Signaller JC Campbell and typescripts of two letters written by Captain Mervin Higgins 8th Australian Light Horse AIF during WWI. STARKE / PRESIDENT LIBRARY COUNCIL ...The Municipality of Kew (1860-1863), the Borough of Kew (1863-1910), the Town of Kew (1910-1921) and the City of Kew (1921-1994) were local government instrumentalities in the State of Victoria. In 1994, the City of Kew was amalgamated, together with the former Cities of Camberwell and Hawthorn, into the new City of Boroondara (1994- ). Like other local government entities of the period, Kew was administered by town clerks. The two notable town clerks in Kew's history were H. H. (Henry Hirst) Harrison (1868-1955) and W. D. (William Dickie) Birrell (1899-1974). Harrison was appointed to the position in 1901 and retired in 1938 after 37 years. Birrell, appointed Acting Town Clerk in 1921, became Town Clerk in 1938, following Harrison's retirement. He continued in this role until his retirement in 1966.This card is part of an historically significant civic collection, containing hundreds of separate invitations, documents, greeting cards, programmes and tickets issued and/or collected by successive town clerks. Items in the collection illuminate the political, social and cultural history of the district. Both are young men. The conductor is adorned with his safety pins and trip slips, that he would punch a hole in when he sold or collected a fare. The bell punch in the conductor's right hand would sound a bell to indicate the fare had been collected. There is a church vicarage in the background - at Prahran terminus in Chapel Street outside Trinity church. Underneath the photo is written "A Paradox: two Badger ?" which is a reference to the General Strike in Brisbane of Jan 1912 by Brisbane Tramway Company workers over the wearing of Union badges which was strongly opposed by the Company Manager Joesph 'Boss' Badger. Tom Kennedy, Jnr, and his wife, Lucy, lived at 109 Pakington St Kew. Tom Kennedy Jnr. died 02 November 1963. Lucy Kennedy died 28 November 1987. "CONTEMPT OF COURT. MILK-CARTER GUILTY. Breach of an Injunction. A Supreme Court writ has been issued by Thomas Kennedy, sen., Thomas Kennedy, jun., Patrick John Kennedy, and Michael Kennedy, trading as Kennedy and Sons, Rose Lea Dairy, against Gordon Allberry Shepherdly, of Barnard street, North Kew, milk-carter, claiming an injunction and damages. Plaintiffs carry on business at Pakington street. Kew, and Melville street, Hawthorn, and they claim In their writ an injunction restraining the defendant from soliciting or endeavouring to obtain the custom of people who were customers of plaintiffs when Shepherdly was employed by them under an agreement dated March 13 1928. Plaintiffs also claim damages. Mr Read (instructed by Messrs. Moule, Hamilton, and Derham) appeared for plaintiffs before Mr. Justice Macfarlan in the Practice Court yesterday, to ask for an order for the committal of Shepherdly to prison, or alternatively, for an order that plaintiffs be at liberty to Issue a writ of attachment against him for contempt of court in soliciting or endeavouring to obtain the custom of plaintiffs' customers. The affidavits set out that Shepherdly was employed by plaintiffs from March I3, 1928. until June 6. 1930. An Interlocutory injunction had been granted pending trial of the action for a permanent injunction. Shepherdly, who appeared in person yesterday, said that he had a sick wife and two children. He had not served any of the customers referred to since the granting of the injunction. He had passed them over to another man for whom he was working. Mr Justice Macfarlan - In doing that you have committed a breach of the injunction, and I have no alternative but to order that you be sent to gaol. I will make an order that you be committed to prison until further order of the Court. I will direct, however, that the order be not executed until Tuesday next. If you can then satisfy the Court that you have ceased to serve, or take any part in serving, the customers of Kennedy and Sons, the order will not be executed. The agreement was the first between the Union and the Company which had long resisted unionism. The Victorian Branch of the ATEA was formed in November 1910. The agreement was the result of an Arbitration hearing before the Commonwealth Conciliation Commission. Frank Brennan & Rundle represented the Union and Louis Waxman the Company. The agreement covers wages for all the Companies employees, working days, rostered days off, travelling time, meal breaks, rosters, Sunday work, exchange of shifts, public holiday rates, training of students, accident reports, ability to wear their union badge on their watch chains, disputes re revenue, trackmen, ropemen, the establishment of a Board of Reference, dispute resolution, breach of the agreement and expiry - 30 June 1916, the day the Company Franchise ended. See item 7361 for a copy of the MTOCo employee rules that reflect this agreement. Signed by L L Hill Union President, A C Warton Union Secretary, H A Wilcox Company Secretary, and W G Sprigg, one of the Company Directors. The supplemental agreement - has a long introduction to the dispute regarding workers being represented on the grounds of alleged misconduct. Notes the name of the Court President, Mr. Justice Higgins. Provides the process for representation of any man who is accused of misconduct, discipline, and proof of the charge. Notes the use of the company's private (detective) staff - known as spotters. The wearing of union badges was the cause of a large General Strike by tramway men and others during 1912 in Brisbane.Yields information about the first agreement between the Melbourne cable tram operator and the Union that represented the workers. "FATHER OF" KEW."In a Village in Somersetshire in England on February 21, 1823, a son was born to George and Sarah Morgan. The child was so delicate that his parents feared that he would not live. How little ground the parents parents had for their fears may be judged from the fact that the boy, christened James Venn Morgan is still alive and hale. He is able to exhibit with pride the paper with its faded ink on which a clergyman wrote the certificate of his baptism almost 100 years ago. But for some slight infirmities of sight and hearing, Mr. Morgan, who is within six weeks of completing the 100th year of his life, is in good health, and is well able to attend to his business affairs. His immediate cause for regret is that he is not now able to do a day's work in his garden, as he was 12 months ago. After spending his early life in England, where he learned his trade as shoemaker, Mr Morgan came to Australia in April, 1851. He carried letters of introduction to Mr. Tripp, a solicitor, of Melbourne, who strongly recommended him to begin business as a shoemaker, and accordingly he opened a shop at the corner of Swanston and Bourke streets, where the Leviathan Stores now stand, and was not long in working up a good connection. Among his customers at that time Mr. Morgan recalls Mr. Justice A'Beckett and many leading men in law and medicine of the day. Then the news was flashed through Melbourne of the discovery of gold at Ballarat. Nothing can give a clearer idea of the excitement this news caused in Melbourne than that Mr. Morgan, who was a member of one of the first parties to leave for the diggings, left uncompleted in his workshop one of a pair of riding boots he was making for Mr. J. B. Weir. As the purchase of suitable clothing would have taken time, he set out to make his fortune wearing a top hat. At Ballarat he stayed for five or six weeks, and returned to Melbourne with 10oz. of gold. He remained in the city long enough to finish the second of the two riding boots, and then, with three companions, set out for Chewton, near Castlemaine. Here fortune smiled. The party tried their luck in an abandoned shaft, and in two weeks returned to Melbourne again after having won 35lb. weight of gold. How Kew Was Born. Mr Morgan was content with his success, and induced his partners to invest their money with him in land. After obtaining the advice of a friend, the party negotiated with Mr Samuel Watts, of Collngwood, who had recently purchased land from the Crown, and from him they took over at £15 an acre about 32 acres of land in the district that is now known as Kew. This land extended from where the Kew Post-office now stands to the locality of the Boroondara Cemetery. At that time there was not a house in the district, and there was a fairly large population of aborigines, but no white men. Here it was that Mr Morgan decided to settle, and, after having had the land surveyed, the partners apportioned it by drawing straws for the four sections into which it had been divided. One of them sold his holding later in the year for £100 an acre, and was sorry for it afterwards. In 1853 Mr. Morgan built the first house in Kew, and this house is the one in which he still resides. Here with his wife, he settled down to market gardening and dairying. He tells with a laugh how he was paid 1/ a lb for the first potatoes he grew, and 1/ a quart for milk. So successful was the new venture that he induced his father and other members of the family to come out to Australia to assist him. How different Kew of those days was from the Kew of to-day will be understood from Mr. Morgan's statement that for weeks at a time they never saw a a white face other than those of the family. The blacks, he says, although very noisy, were entirely friendly. Gradually the district became settled, Mr. Morgan parted with a portion of his holding, and subdivided and built on the remainder which he still retains. In 1884 he found himself in a position to retire from active business. Youth in Old Age. In Mr Morgan's garden, which is a large, one trees which he and his father planted more than 60 years ago are still bearing heavy crops of apples. Mr. Morgan has been a widower since 1915. He has three daughters all of whom are married, and numerous grandchildren and great-grandchildren. One of the great-grand children reccntly informed Mr. Morgan that he was about to be married. Perhaps the most striking characteristic of Mr. Morgan to-day is his activity. Not only does he move about with surprising alacrity, but is able to go into the streets and attend to his business affairs with but little fatigue The Argus, 17 January 1923, p.12.This work forms part of the collection assembled by the historian Dorothy Rogers, that was donated to the Kew Historical Society by her son John Rogers in 2015. The manuscripts, photographs, maps, and documents were sourced by her from both family and local collections or produced as references for her print publications. Many were directly used by Rogers in writing ‘Lovely Old Homes of Kew’ (1961) and 'A History of Kew' (1973), or the numerous articles on local history that she produced for suburban newspapers. Most of the photographs in the collection include detailed annotations in her hand. The Rogers Collection provides a comprehensive insight into the working habits of a historian in the 1960s and 1970s. Together it forms the largest privately-donated collection within the archives of the Kew Historical Society.A group portrait on the occasion of the 100th birthday of James Venn Morgan in 1923. This is an extract from the Victorian Parliamentary Debates on Tuesday 18th July, 1922. It is titled "Death of the Honorable James Cameron" and is a tribute from Mr Lawson, the Victorian premier. In 1882 James Cameron was the first Orbost councillor of the newly constituted Tambo Shire. In the next twenty years he served as justice of the peace, shire councillor, guardian of St James's Anglican Church, Sunday school superintendent and president of the local agricultural society. In 1902 he won a by-election for Gippsland East and took his seat in the Legislative assembly. He serve for eighteen years and his main achievements were securing one million pounds for East Gippsland development bringing the railway to Orbost and establishing the Country Roads Board.James Cameron was an early Orbost pioneer, a respected community member and a prominent politician.A memorial extract from the Victorian Parliamentary Debates.
